Trend towards mean-spirited media reporting

Since the inglorious days of the Duke Lacrosse party of March 2006 and its aftermath, it seems to me that the media has adopted and honed to perfection the art of cruel, inhumane, and malicious reporting. Without doubt, the Duke case provided plenty of fodder for the media-types upon which to cut its teeth, especially by going after former Durham District Attorney Mike Nifong. In kowtowing to the Carpetbagger Jihadist agenda to seek-destroy-annihilate anyone on the wrong end of the Duke Lacrosse case, the media, with bloodlust relish, crucified Mike Nifong at every turn. No stone was left unturned when it came to Mr. Nifong, and truth, relevance, and objectivity presented no limitations. The worst example of a libelous attack against Mr. Nifong was by MSNBC senior legal analyst Susan F. Filan, who lied in an article by stating that Mr. Nifong asked his son to attend his hearing in an attempt to garner pity and sympathy. Then, based upon the falsehood that she had manufactured, she went to task attacking Mr. Nifong’s character. The truth of the matter is the opposite of the media-reality created by the Nifong detractor. Mr. Nifong specifically asked his son not to attend his hearing, but his son insisted upon showing support for his unjustly targeted father and was present at the North Carolina State Bar hearing; which was more a resemblance of a kangaroo court.

As stated earlier, everyone on the wrong end of the Duke Lacrosse case was fair game for the media headhunters. Brian Meehan, the lab director whose company provided DNA results for the prosecution, was ridiculed by the media after he was unjustly axed from the company he helped establish. Duke Lacrosse case investigator Linwood Wilson’s personal bickering with his wife was dredged across the headlines… a perfect example of mountain making out of molehills. Vying for the cruelest coverage of all, was the way the news portrayed incidents involving the Duke Lacrosse victim and accuser Crystal Mangum. A litany of examples are on hand, with the most recent being the Reginald Daye autopsy report. Although the media has been alerted to the criminally fraudulent and bogus April 14, 2011 Examination of Autopsy Report, it has shown no curiosity as to how or why it differed from the Investigative Report of Death from April 13th. The media was quick to announce that the autopsy report showed injury to “six major organs”… the only problem is that the media relied upon the muscle called the diaphragm to be re-classified as an organ, which it is not. Furthermore, the report of the 13th , which is the far more reliable and accurate of the two, acknowledged only the splenic flexure of the colon as sustaining any stab related injury and receiving any attention during emergency surgery on Daye. ABC-11 television news was also quick to announce that Ms. Mangum stabbed Daye multiple times (seven) which was disproved by both reports. The media is at the ready to help the state keep concealed the truth behind Reginald Daye’s death from a stab wound… trauma from he most assuredly should have fully recovered.

Another gold mine source for the media has been provided by the NCAA’s investigation of the University of North Carolina’s football program. The self anointed organization headquartered in Indiana has as its objective to create athletic-academic crises in order to justify its relevance and the seven figure annual incomes of its top tiered executives. It pretends to place a premium on academic excellence while policing collegiate sports. Using a heavy hand it smashes the opportunities of many athletes to showcase their talents by arbitrarily handing out suspensions, fines, and banishments… usually for the alleged offense of accepting “gifts.” One UNC football player was deemed to have received a fifty dollar gift and the NCAA slapped him with a one game suspension. It is so ironic that the avaricious NCAA organization with it overstaffed and overpaid workforce is so bent on depriving a few athletes from underprivileged and disenfranchised origins from making a few bucks… this, while the NCAA is raking in the dinero hand over fist. Marvin Austin and Michael McAdoo were but a few of the students athletes caught up in the media storm, with McAdoo being cited for receiving “improper academic help” from a tutor. Although he received an F grade in the class, the NCAA tacked on an additional penalty… permanent ineligibility to play college football. The NCAA actions in this case, as in many others too numerous to recount, are examples of excesses in authority with draconian rulings that are arbitrary and capricious.

The media has been especially hard on the fired coach Butch Davis and one of his assistants John Blake. It seems that Blake had a relationship with a football agent of which the NCAA did not approve. Talk about piling on… Blake was unmercifully hammered in media. The News & Observer led the media charge against McAdoo’s professor, Julius Nyang’oro, who was forced to step down from his post as the chair of the Department of African and Afro-American Studies. His alleged culpability was not informing the Dean about a hiring decision he made of a qualified instructor who happened to work as a sports agent.

The main problem at UNC is that its chancellor, Holden Thorp, is shell-shocked. The NCAA really did a number on him, as every miniscule perceived infraction that is connected with UNC college sports is immediately reported to the NCAA. It is pitiful the amount of power the NCAA has over Mr. Thorp and college sports in general. The universities and colleges should unite and force the abolishment of the NCAA which is nothing more than a parasite that is drunk with power and is running rough-shod over student athletes and college administrators.

The News & Observer sports columnist Luke DeCock wrote a truly bizarre article in the September 6, 2011 paper titled, “Withers made bad call with game ball.” Evidently, it’s not enough to just win the football game… now what you do with the game ball is what really counts? DeCock accused UNC football coach Everett Withers of “calling attention to the Tar Heels’ sullied past instead of their new future.” What does he think his article did? First, I, although not an avid sports follower, was unaware that the game ball was given to former coach Butch Davis… until I read DeCock’s column. Second, so what? Big Deal. It is evident that former coach Davis was largely responsible for recruiting many of the team’s members and helping them to develop into a force capable of defeating James Madison by the score of 42-10. The players naturally had affection towards the former coach and Davis was a friend of current coach Withers. So why not give him a game ball that the coach and players felt he deserved? Certainly such an action was not meant to embarrass an overly sensitive chancellor or serve as a detraction. More ink was given to the story about a game ball given by Withers to Davis than to the ponzi scheme which snared North Carolina State University Debbie Yow’s new basketball coach. Somehow, I do not think The News & Observer has its priorities straight.

Finally, there’s The News & Observer’s three part investigative series by J. Andrew Curliss which does a hatchet job on Durham District Attorney Tracey Cline. To summarize my assessment of the series, it was a bunch of sound and fury signifying nothing. I am not the only one to be of that opinion. It is obvious that she is coming under fire because she is a friend of her predecessor Mike Nifong, and because she has treated him with civility… and the Carpetbagger Jihadist position strictly forbids that, as they follow the dictum that “the friend of my enemy is my enemy.” Claiming that Ms. Cline is under fire is a ruse to get the public to believe that there is widespread disapproval in her work. From what I see, the only disapproval of her job performance is from The News & Observer. Alas, a review of the media treatment of Ms. Cline is worthy of a blog itself.

Instead of hyping sensational stories with the intent of ruining careers, tarnishing reputations and destroying lives, all media-types should make a conscientious effort to report the news fairly and objectively. That would be the best service they could provide for its consumers. 

Hatchet job? Curliss' article is quite tempered, presenting just the facts. It's difficult to believe that you approve of her methods.

It's ironic, Sidney, that you call Cline the victim of a 'hatchet job' when the article shows that she repeatedly employs unethical and illegal methods to secure convictions - something that you (quite rightly) complain about on your blog when it involves other NC DAs.

Your hypocrisy is amazing in its breadth & depth.

Cline...only the media have a problem with her performance? Not the courts that have overturned verdicts with specific harsh words of criticism for the State? meaning her office.
Nifong.....crucified by the media? really? a kangaroo court? the son showing up to support dear old dad? I bet the son was just all teared up when he heard the EVIDENCE against nifong. Nifong abused by the media, you say? You refer to Nancy Grace with prase as a prosecutor, yet you claim to have never seen her TV abortion of a show, and YET you know nothing of how she RIPPED the lacross players, referring to them on television as "animals", a la the lovely letter sent to Dave Evans' mother telling her she had given birth to a farm animal. You mean THAT Media?
And our infamous sister survivor....poor single woman, mother, trying to work her way through college........and, of course, she had no choice but to wrap herself around a pole and make social calls on hotel rooms to earn just enough to scrape by.... and, of course, the fact that there was ZERO EVIDENCE to support her many lies....god forbid we should consider EVIDENCE, Sid. You mean the media that published Nifong's remarks about how he was "sure" a rape was done that night? THAT media?
And, Mr. Daye, now deceased and falsely accused of being an alcolholic by the ever-cloying Sidney who would not know an autopsy report from a McDonald;'s bill. The media hasn't responded to sidney's informed experienced scientific expertise and invited sidney to publish the one-true-real-honest-to-god TRUTH of "innocent sister". THAT media?

The final witness in the trial of Frankie Washington was his prosecutor, Tracey Cline.

Cline had pursued charges against Washington for more than four years, accusing the handyman of burglary, robbery, kidnapping, assault and an attempted sex offense in a frightening West Durham home invasion.

At the trial in late February 2007, Cline was in the witness box, an unusual spot for a longtime assistant district attorney. Washington's attorney, preparing for an appeal, wanted to question her about forensic tests on the evidence - a winter hat, a bandana, a pistol-grip shotgun and a stolen purse.

Crucial testing of the purse and the hat had taken years, delaying Washington's trial. The attorney, Lawrence Campbell, had complained for years about those delays. Now, he wanted Cline to tell the jury what happened.

Cline repeated what she had told a judge in a previous hearing: The state crime lab was responsible for the long delays.

But records tell a different story. Cline had not submitted the evidence to the lab for more than three years. It was Cline's job to ensure that the evidence, along with a judge's order to test it, were sent to the lab.

When the evidence was finally tested, none of it matched Washington.

Washington still was found guilty, but his conviction was thrown out by the state Court of Appeals - and the judges cast doubt on whether he committed the crime. The court cited the prosecution's "repeated neglect."

I am unfamiliar with the Michael Dorman case. With regards to the Derrick Allen case, I am under the impression that he shook the baby too violently, causing her death, but that he denied sexually assaulting her. I have not closely followed that case.

First of all, I did not elect Ms. Cline as I am a resident of Raleigh, not Durham. Her point is well taken as these missteps are not restricted to Durham County but occur throughout the state.

I am not at all pleased with Durham County's treatment of Crystal Mangum, but I wouldn't single out Ms. Cline because of it. She should be aware that I strongly disapprove of the prosecutions of Ms. Mangum.

To say that you're unfamiliar with the Dorman case is tantamount to saying that you didn't even bother to read the articles you claim are a "hatchet job". You DIDN'T read them, did you?

Case was thrown out, Sid -- By Judge Orlando Hudson. Why, you ask?
"Prosecutors in the case of Durham's Derrick Allen "knew that some information they intentionally failed to disclose was exculpatory information and that their suppression of favorable material was a violation of Mr. Allen's constitutional rights ..." under both the state and U.S. constitutions, the Durham-based judge said in an order Thursday."

Some time ago I mentioned Leon Brown to Sidney. Tracey Cline prosecuted Mr. Brown for rape in 2001, I believe. She promised the jury she would prove him guilty beyond a reasonable doubt.

The victim identified a caucasian as her assailant. Mr. Brown is African American. The DNA evidence did not match Mr. Brown's DNA. The Jury found Mr. Brown not guilty. The Jury Foreman castigated Tracey Cline for wasting their time. She simply had no case.

Sidney said he had never heard of Mr. Brown and said he lived in Raleigh, not Durham. He could not explain how people hundreds of miles from Durham would know of Leon Brown.

Ms. Mangum did not kill anyone. Reginald Daye died as a result of gross medical malpractice and/or hospital homicide. That is why the media is reluctant to write about Mr. Daye's death.

Crystal did not steal anything from Daye. With her money, she purchased two money orders made out to the landlord, but used Daye's name as the purchaser. Daye was on the lease, and if she would have used her name, the landlord might have evicted them both. Daye wanted to use the money to buy beer, whereas Crystal wanted the money to go towards rent, and that was what the argument was about that led up to the stabbing.

So, the prosecution charged Mangum with two counts of larceny, one for each money order, the money orders for which she was the actual purchaser.


In a few minutes I will post a blog about the racist pardon policies of Governor Bev Perdue.

If that were true, dozens of contingency fee lawyers would be camping outside the Daye family home, pleading with the Daye family to file suit. That is not happening.

Personally, I hope the Daye family files suit against Durham and the Durham PD over the way it handled Crystal Mangum's criminal behavior. That would lead to discovery which would reveal facts about her criminal history which her supporters would like to keep under wraps.

Smith vs.Schmidt No US court has yet weighed in with authority on the debate about whether bloggers count as journalists, but the recent federal decision from South Carolina does indicate that at least some bloggers are journalists. It's not about the title, it's about the content, said Judge Henry Hurlong, Jr.; a journalist turns out to be anyone who does journalism, and bloggers who do so have the same rights and privileges under federal law as the "real" journalists.

My point, Kenhyderal, is that there are no "confidential sources". Sid claims medical information that no healthcare worker would reveal for fears of violating HIPAA privacy rules.

Considering what he's written here about Mr. Daye, I'm certain no family member would share this information, either.

So, if no healthcare worker would share, and no family member would share, then where does the information come from? Easy -- Sid makes it up.

Or, of course, some Duke Hospital employee who is just itching to get not only fired but also prosecuted by the Feds (which is what happens with a HIPPA violation) would just, whooopeee, call from good old Sid and willfully violate the law. There was an ad in this Sunday's Herald-Sun from Tracey Cline (wonder who paid for it?) inviting Andrew Curliss to "A Public Question and Answer Forum on his articles entitled Twisted Truth"...
The only problem is, Curliss and the editors at the N&O had already declined this idea (it came up in their meeting -- the audio about it is available on the N&O website). The editors suggested instead that Cline and Curliss both appear on a neutral forum, such as WUNC. Cline did not take them up on this offer.

Why would Cline

1) Take out an add inviting Andrew Curliss to an event that the editors at the N&O have already declined?

2) Decline an opportunity for a neutral forum?

The event was scheduled for yesterday afternoon at 5:30 pm...Did anyone go?

At the "town hall" meeting last night, Tracey Cline agreed to air her complaints about the Twisted Truth N&O series in a neutral public forum (with moderator) at N.C. Central University Law School. No date is currently set, and Cline is supposed to detail her complaints in writing for the N&O.

I suggested, perhaps a person, other then a Family Member, who had access to information regarding Mr. Daye's condition and his expected discharge, acquired either from personal knowledge or from being told so by a Family member or friend but not, necesarily,themselves unfriendly to Dr.Harr, in confidence, passed on what he/she knew. Where there is little risk of being found out Hospital workers, in violations of confidentiality, do, wrongly, give out personal information about patients.

Sid -- Not sure if you're still reading these comments, but Judge Orlando Hudson himself is now on record stating that "Tracey [Cline] is still responsible" for Durham prosecutors and the State Bureau of Investigation violating the law by withholding key evidence in the Derrick Allen case.

Is it still your opinion that this all signifies nothing?
