Ten is not enough

(Note:  UPDATE ON POSTING OF THE SUPER-FLOG)

Work on the Super-Flog is moving along nicely, but because it is such a huge project, its completion is taking longer than anticipated.  The latest ETP [Estimated Time of Posting] is Saturday, January 5, 2013.  It will contain information about the State Bar's action against me, as well as important never-before-seen prosecution discovery that will blow your socks off. 

Please be patient as the Super-Flog will be well worth the wait.

On the last day of 2012, Monday, December 31st, North Carolina Governor Bev Perdue issued pardons of innocence for the group of defendants known as the “Wilmington 10.” For the past seven months she had been under increased pressure to pardon them, as new evidence was unearthed that cast further doubts on the fairness of the criminal trial held forty years ago.

The trial and subsequent convictions of the nine African American men and Caucasian woman stemmed from civil unrest in Wilmington in the early 1970’s over school integration. The ten were charged and convicted of firebombing a white owned grocery store in a black neighborhood and then firing weapons at emergency responders. Amnesty International and journalists questioned their arrest and the fairness of their trials, and in 1978 Governor Jim Hunt commuted their sentences… but he withheld a pardon pending an appeal by prosecutors. Two years later, in 1980, the U.S. Fourth Circuit Court of Appeals overturned the convictions citing prosecutorial misconduct.

The Wilmington Ten injustice is one that should not have taken forty years to rectify… during which time four of the ten have died, and all have had trouble recovering from the injustice and stigma of being a convicted felon.

I applaud Governor Perdue for pardoning the Wilmington Ten, however, unlike others I do not feel her actions were courageous or heroic. With the mounting evidence turned up by author Tim Tyson which highlighted the many misdeeds and malfeasances of the prosecutor Jay Stroud during the trial, she really had no alternative but to grant a pardon of innocence. Instead of waiting seven months after the petition for clemency was filed before making a decision, Governor Perdue should have acted immediately in granting the full pardon.

The governor was slow to issue a pardon of innocence in the Gregory F. Taylor case too… the only other instance where she granted a pardon during her four year tenure as the state’s chief executive. I wrote her three letters during the months following Taylor’s exoneration by the three judge innocence panel pleading for her to grant a pardon of innocence so that he could pursue compensation for his seven years of wrongful incarceration.

I am in disagreement with all the plaudits heaped upon her by Benjamin Chavis (one of the Wilmington Ten), U.S. Representative David Price, and NAACP State president Dr. Rev. William Barber, II, the editorial board of The News & Observer, and others because Governor Perdue fell woefully short by failing to issue pardons of innocence to Erick Daniels, Shawn Massey, and Glen Chapman… three exonerated black defendants, the first two being denied pardons by the Governor’s Clemency Board, and the latter who was wrongly convicted and put on death row. The innocence of these three men is undeniable, with no forensic evidence connecting them to the crimes for which they were charged, and witness descriptions in the first two incidents being at odds with the defendants. Erick Daniels was fourteen at the time of his arrest on an armed robbery charge in which he was identified by the shape of his eyebrows in a middle school yearbook. He served seven years of a ten to fourteen year sentence before his conviction was tossed during a hearing for a new trial. Shawn Massey, like Daniels, differed dramatically in hair style described by witness to the robbery for which he was convicted. He served twelve years behind bars before an innocence project at Duke University Law School took up his case and successfully affected his exoneration.

Glen Chapman, who has had his petition for a pardon of innocence filed with the Governor’s Clemency Panel for more than a year, has not been issued a ruling.

These three men have had the best years of their lives wrongfully taken from them by a selective justice system that is based on Class and Color. Freedom, is without doubt the most valuable possession a man or woman can possess, and to have it wrenched away without probable cause or credible evidence is devastating. In addition, the wrongful conviction for a felony results in a stigma which has an adverse bearing on the innocent defendant’s life forever.

Erick Daniels, Shawn Massey, and Glen Chapman are all deserving of a pardon of innocence so that they can pursue compensation to which they are entitled by laws enacted by the North Carolina General Assembly. They deserve to be pardoned now… not in another forty years or so. Governor Perdue has had the opportunity to clean up the criminal injustice slate involving the three, but it looks as though she will let it pass. I am not surprised as she as proven to me that she lacks the Nifongian courage to do the right thing. The governor can make all the flowery and political correct speeches she wants to about past and present racial injustices, however, when it comes down to it, it’s nothing more than meaningless talk… as racial injustice continues to run rampant and she, with the opportunity to do something about it, has taken no action. The least she could have done is deliver pardons of innocence for Daniels, Massey, and Chapman.

As far as I am concerned, the governor’s failure to grant pardons of innocence to all thirteen mentioned above represents a disappointing end to a disappointing four year gubernatorial tenure… and leaves her with a disappointing legacy.

Requests for pardons if innocence are typically submitted at least five years after a former inmate has achieved good standing in his or her community. That is not the case for either Massey or Daniels.

Chapman's request is (as you noted) still pending.

I disagree with Walt on this point. As Lance notes, there is a timeline involved. Also, I believe Perdue was correct in exercising restraint on at least somewhat of an individual basis. None of us is privy to all the circumstances and actual evidence in the case; we all have our news filtered. As far as I am concerned, anything written by Tyson is biased beyond all semblance of the truth. I congratulate Perdue on the actions she took.

As I pointed out in a prior response regarding Massey and Daniels, most of the requests for pardons of innocence are submitted at least five years after a former inmate has achieved good standing in his or her community.

Violating the law by carrying a concealed weapon is NOT a proper way to achieve good standing in most communities.

Erik Daniels had a long criminal record as a juvenile. He was involved, on the outside, with the robbery but was given his freedom when Orlando Hudson found that his lawyer did a lousy job and that there was evidence in the case that might have meant Daniels would not have gone to prison. After he got out of prison, Daniels did NOT make a sustained good faith effort to establish himself in society He was arrested for not only carrying a concealed weapon but also carrying illegal drugs. He claimed the drugs were his but that claim was not substantiated. His past, before the conviction, and his behavior, after he got his freedom, show a long history of borderline criminal behaviors.

I guess, according to SIDNEY, past behavior is relevant only in the case of the Lacrosse players, who were falsely accused of raping Crystal. Their history was no where near as intense as the history of Crystal or as the history of Eric Daniels, but to SIDNEY it was enough to presume them guilty of a crime which never happened.

Gregory Taylor's case was coordinated through North Carolina's Center on Actual Innocence. Daniels' case was not.

Actually, I don't think it's really Kenhyderal. Whatever failings he has shown, he doesn't seem the type to post anonymously.
In any case both the 7:41 and the 8:38 are word-for word repetitions of some things he wrote a while back. They may have been reasonable then (they referred to recent events) but not now. For one thing, it's clear CGM is not going to get bail. For another, there hasn't been any of that "repetitive chanting" lately.
So what is this? another troll, perhaps?

You've really bought into the metanarrative about the 2002 incident. The first thing the Duke Lacrosse Defence did in the rape case was to try and dig up something that would discredit the victim. They quickly uncovered the case with a taxi driver and the supposed theft of his cab. Wildly exaggerated stories appeared right left and center about it suggesting it was grand theft auto, dangerous driving,felony fleeing, attempted vehicular homicide and drunken driving. It's disposition with three misdemenors and three weekend in gaol indicate the real nature of the incident. Crystal thought she had permission to drive the vehicle. Her so called high speed chase was 10 mph over the limit. It was called a chase because she initially did not see the flashing lights. There was no deliberate attempt to run into the Policeman. In trying to park she accidentally sideswiped him as he approached.

There was no metanarrative. The description of Crystal's cab theft incident came from police records generated in 2002 after Crystal tried to run down the officer and before she became notorious for false accusations.

This is a perfect example of the kind of abuse and mischief that is inherent in allowing anonymous posting and what's worse it allows lurking cowards to hide behind anonymity in spewing racism and slander. I would like to see, at very least, a blog regulation that demanded a poster have a user-name. Why would that be unacceptable to any person of good-will? What is the value of anonymity here? It only gives persons without the courage of their convictions a forum

I do KNOW Crystal Mangum and she IS a substance free hard working single Mom who tried to raise her children in a good home. Assertions to the contrary are only based on cruel lies that have been widely circulated. The motive for which I"ll leave up to others to speculate upon. I have my own opinion from where they emanate.

The woman has been a user of men all her adult life. She makes money off them; they get what she sells in return.

Mangum lied initially and said she did not start the fire in Walker's apartment. She admitted it later, during an interview for the Wives With Knives episode. Kenny wants to be word-picky and claim that she did not commit "arson", so , technically, she didn't lie. Another one of his silly and feeble attempts and side-stepping. Mangum set the fire, period. What I find appalling is that she did this in front of at least one of her children. That's just flat out nuts. Nobody is going to tell me that Mangum is some kind of good mother, when she shacks up with anything in pants and carrying a wallet.....drinks, gets violent, curses like a deckhand......sets a fire......in the presence of her child. She didn't get a conviction on the arson charge because the jury was hung on it. That failure of conviction is NOT the point. She set the fire....by her own admission....in the presence of her child/children.

Ken Edwards, aka Malek, seems to think that there is some relationship between the quality of a post and the partial identification of the poster. frankly, who cares. Whether a person identifies themselves has nothing to do with expression of opinion......and whether the opinion has merit or is baloney. Ken Edwards somehow wants to control/censor the exchange of opinions....again, who gives a flip.

Harr wins the Hypocrite of the Year award, yet again! Michael Jermaine Burch is due to get out of prison. He raped a woman in 2007......she was white, he is black. He posted bond. In 2008 the SOB raped, yet again. Hudson sent him to prison. Where's the outrage from sidney? An apparently innocent woman, a student, attended a party sponsored by a group of men . (black guys in a frat), got raped (she did NOT lie about it....). Silence from Harr. No righteous indignation from him about the innocent victim. No ranting about the rapist. I guess if the perps are white (even if they are NOT perps), and the non-victim is black, then harr gets his shorts in a twist. Otherwise, nope.....not a word of his slobbering pity and high behind judgement. Amazing, isn't it. A man rapes two women (at least), spends a bit of time in prison and gets out.......what do you bet he does it AGAIN and soon. But, Harr worries not......because the convicted rapist is a black man and, golly geez, the poor guy probably got framed or something.

Believe it or not, a person can make a racist comment in this country, Kenny. Some of us may not like it, or agree with it.....but we live in a society where freedom of such speech is protected, so long as it does not go beyond certain boundaries. You want sidney to censor out speech that you think is hate speech or slander. I may want YOUR speech censored because I may think YOU routinely make highly racist remarks. The point here is that you want comments removed that you don't like.
I don't particularly care whether harr censors this site. That's his option. Matters not to me one bit.....nor does it matter what you think. You are entitled to your opinions. As you have been told, trolls can post....nobody gives a hoot.

When working with advanced and complicated documents in Flash, it is not that difficult to accidentally damage a document. That's what happened last Friday as I was nearing completion of it. As a result I had to start over, but re-doing it has gone faster as the files were not damaged.. Currently I am back to the point I was when I lost the document.

All things considered, I hope to have the Super-Flog uploaded and available by Wednesday or Thurday of this week.

One would think that a rape, at a party sponsored by Duke students, would have been significant to Harr. I am certain Ken Edwards would happily disclose his home address, home phone, and other pertinent information to the Chinese government, each and EVERY time he posts....which is a current requirement in China.
As much as I hate racial remarks and the horrible homophobic content from groups like the Westboro Baptists and the New Black Panthers......I would fight like hell to protect their right to free speech....obnoxious tho it is. Kenny Troll tries so hard to puff himself up, with his righteous indignation....and it's fairly transparent.
Meantime, Mangum goes to court this month, right?

In Canada, unlike China and the US, the people do not fear their Government, be it conservative,liberal,socialist,or communist. And we don't need a protection in our Bill of Rights that allows us to arm ourselves against that Government. We rely on democracy and for us that Party with the most votes, numerically, gets to rule and we have more Parties that have a realistic chance at forming a Government, than the big two, to chose from. There is no such thing as a "super majority". Our Senate is unelected and has no power other then being an advisory body. Senates are by their nature un-democratic; like in the US where Wyoming can tie California, that has 65 times the population. One man one vote, of equal weight and the numerical majority wins. In Canada there are meaningful caps on campaign spending and lower contribution ceilings for individuals. And we have restrictions on third-party involvement. Third parties(individuals or non-profits) can only spend $188,250 on a nationwide ad campaign during the lead-up to a federal election. Corporations and Unions are banned from such activity. No "Citizens United" rulings, here, that allow oligarchs to sway the process. Even President Obama buys into the myth of American excetionalism. He is fond of saying only in the US would my story be possible. Wrong, there are scores of democratic countries where a poor minority could rise to the highest post in the land and in most places it was possible generations before it was possible there. We don't have a constitutional right to bear arms but we do have a right to a univeral comprehensive, single payer health care that costs Canada, with 100% coverage, less per capita then there, where so may remain uncovered. Medical statistics indicate we are a healthier, longer-lived people. And, when we hear the Insurance company propaganda lobby spreading lies about people dying on waiting lists and death panels we just scoff.

You know, I was in Stockholm last month, for the Nobels. It was interesting to see that, of the nine laureates, five were Americans. The others were Chinese, Japanese, British, and French. There were no Canadians, so I looked back over the past three years (2010-2012). There were 16 Americans, and one Canadian. Since the U.S. has nine times the population, the 16-1 ratio in prizes doesn't seem too bad -- until you realize that the one Canadian won his prize for work he did after moving to the United States. I then looked at all the laureates since these prizes started. There are 336 Americans, and 21 Canadians. Again, the 16-1 ratio doesn't look so bad -- until you realize that 6 or 7 of the Canadians got their prizes for work done after settling in the United States. In fact, then, the ratio is more like 22-1.
This is not to say that Canada's a bad country -- in fact, I have friends there and I enjoy visiting them. But it does seem that something -- perhaps the elan vital -- is missing. It's easy to point out the nice things Canada has -- you should also look at what it is that's missing there.
Meanwhile, please do not lecture us about the difference between the two countries -- at least until you get the Nobel laureate ratio down to 16-1 or 17-1.

I would also like to point out that physicians continue to move from Canada to the United States in numbers that FAR exceed population adjusted expectations. I am involved with an AMA study that is looking at the reality of physician professional satisfaction in Canada. The truth is that Canada has turned healthcare into a commodity and physicians are expected to be encounter machines....with little or not attention to true quality of care and, importantly, outcomes. There is much good in the Canadian system.....BUT, much bad as well. Mayo, Hopkins, Duke, Emory.......versus....Canadian hospitals. Where do you want your parents to go? And why, folks, are doctors coming to the USA to practice?
Canada may have its good points. I am certain it does. Frankly, who cares? The troll goes on and on......again, Kenny, move to China and enjoy censored interest and controlled speech. You will do well there, pal.

Rating Hospitals is a mugs game. One has to ask what area do they specialize in. Sure the USA has many centres of excellence. In the area of Cancer treatment Canada's Princess Margaret Hospital ranks in the top five in the world along with Johns Hopkins, M.D.Anderson/Houston, Dana Faber and Sloan Kettering but PMH is just as accessible to a homeless person as it is to a billionaire. As far as overall health care the US, in a World Health Report, ranks a dismal 36th with Canada 30th and France 1st. I'm sure Lance is going to complain that discussion this has nothing to do with Justice for former DA Nifong

Canada was still carrying out forced sterilizations until 1972. The primary motivation is concern for the QUALITY of care that is being negatively impacted by forced productivity standards.....imposed by the government. Seeing 50 patients a day in a primary care clinic is NOT quality patient care.
