i'm glad she has a lawyer - whether or not there is a conflict of interest and a bias against her by her new lawyer remains to be seen.

no wonder the deaths from domestic violence in nc has increased this year.

how were the very same cases tried about self-defense in the state before the castle doctrine went into affect. if you want to try this case on-line, that is where we should start. all of us non-lawyers can take apart the castle doctrine - look to see exactly why it was put in place for what reasons - and then take those whys and whats and wherefores - and figure out how it was addressed for the benefit of self-defense before the castle doctrine - and wha la - you have your defense strategy just like everyone else did before the castle doctrine.

Mistrial, not mistrail. Recuse, not recluse. A recluse is someone who avoids others. Recuse is a verb, an action word. Let's try to learn the difference. Mistrail is simply non-sense. You would be somewhat more persuasive if you at least tried to use English. It's the common language here.

Now, what conflict of interest? Was Cooper representing Duke at the time of the lacrosse hoax? Was he working on the side while he was the elected Attorney General? Did he previously represent Duke or an affiliated organization when he was in private practice? His law firm does not list any Duke or Duke related clients. Trust me, in this competitive legal environment, a well paying client like Duke would be high on any law firm's list of representative clients. But, if you have knowledge of Roy Cooper representing Duke, please let us know. Otherwise, your claims of conflict of interest are bogus.

There is a difference between advice and legal information. All I have given here is information. Advice, creates an attorney client privilege. Information is allowed under the NC Rules of Professional Conduct.

The doctrine of self defense dates at least to Roman times and generally holds that one can use otherwise illegal force to defend him or herself from an attack. Some states allow the use of deadly force in certain circumstances.

The Castle doctrine in North Carolina is found in N.C.G.S. 14-51.2, 14-51.3, and 14-51.4 which address several of the circumstances in which a person may use defensive force. The statutes restate the law in some respects and broaden it in others. The courts will have to examine their procedures closely to give effect to the new statutory language. The new statutes are part of S.L. 2011-268 (H 650), which applies to offenses committed on or after December 1, 2011. Thus, they do not apply to the case against Crystal.

Crystal's case will be governed by our prior decisions. Even the most poorly informed person must know this if they wish to participate in the discussion in a meaningful fashion.

With friends like you, Crystal doesn't need any enemies.

the reason they could, so they did, is because of the conflict of interest with duke in the judicial system and beyond, that's how they got away with it so long.

I do not hate other posters. You are obviously mistaken.

I had not heard about the story you posted, and wanted some more details. Your comment was hard to follow. I found the story in the Herald-Sun.

Duke administrators had warned the lacrosse coach to rein in his players. Duke administrators were aware of Duke lacrosse players' reputation and their run-ins with the law. Duke suspended the lacrosse season after the incident... and rightfully so. The lacrosse team was out of control.

Duke, for some reason, has some kind of grudge against Mike Nifong and Crystal Mangum... and me because I advocate for them. That is misguided and they should not be contemptuous of anyone. But I think it hubris is responsible for its hate-filled attitudes.

1. If the Powers-That-Be wanted me to know their identities, I would.
2. The Powers-That-Be are kowtowing to the desire for vengeance of the powerful and privileged families of the Duke Lacrosse defendants. "How dare Crystal Mangum accuse their darling innocent boys of anything?"

3. I believe that as district attorney, Tracey Cline should have dropped the charges against Mangum. I don't know why she didn't, but she was not the head prosecutor on the case. I criticize Kelly Gauger and Charlene Coggins-Franks because they are the ones involved with the malicious prosecution. I also am critical of the current D.A. The question is how to prove Reginald Daye's care was negligent. SIDNEY HARR is the only individual with an MD degree who has alleged that Duke was negligent. As you yourself have stated, SIDNEY would need expert witnesses to establish negligence. A number of expert witnesses have weighed in, including Crystal's expert, Dr. Roberts, and they have agreed Duke was not negligent.

So, again, how would you prove negligence?

What Dr. Roberts said to Crystal about the autopsy report and Daye's death was a lie... and that is the reason she is refusing to put anything in writing. You are not going to find any doctor who is willing to put something on paper that will implicate the Medical Examiner and embarrass Duke University Hospital.

That is a possibility. So, achieving a change in nonviolent manner - yet still achieving the goals of liberty and justice for all by change if needed - as in the example given by all great civil rights leaders is paramount in this case - unless you actually want to play right into their hands - which most don't (since most are not of the one percent yet still hold the same rights as them in USA, and have the same and equal rights for the legal and judicial system to support and enforce those rights.; April 14, 2013 at 4:39 AM

Sidney, thank you for all your answers. You've done a lot of work, and many are hoping that Ms. Mangum is given a fair trial and not held in prison the rest of her life for Duke's medical errors, which, if you think deeply enough, is the reason for Duke's wrathful behavior towards all. I cringe when I think of Duke these days with their new money incentives not to have people return to their hospital within a certain time after admittance. I wonder what they will do if they think they messed up and the person will be back before the money time limit is up.

I am hoping, and I believe, that all charges against Mangum will be dropped or dismissed before she goes to trial. I don't trust the defense attorneys to fight as aggressively as they should on her behalf.

Duke University is all about money and power, and that is why it thought it could just toss me in jail for being an African American. I'm not dumb, so you'll never find me knowingly on Duke University or any of its properties, including its hospitals. Regarding Daye's case, they definitely are trying to cover up the esophageal intubation... but it's too late because the documents supporting it are already online.

Sid, the alleged Medical Doctor, ignores the scientific evidence in the lacrosse case. That makes a mockery of his other claims about lacrosse.

In the instant case, Sid ignores the law St. v. Welch or he wants Crystal to get convicted so he can use her case as a means to challenge the felony murder rule. Sid ignores the medical evidence because it suits his cause. He invents a false cause, esophogeal intubation, which is meaningless to her situation simply to fool Crystal into believeing him rather than the good legal advice she has received from excellent lawyers who are trying to obtain an acquittal or at least minimize the damage to her.

With friends like Sid and his supporters, Crystal doesn't need any enemies. She's been sold a bill of goods by some truly dishonest people who are just using her for their own ends.

Here's my best guess....at the moment: Mangum is not going to go free as Harr has continually fantasized. She is either going to get and accept a plea deal or go to trial. I hope, for her sake, that Holmes is able to convince her to take a reasonable plea deal.....it sure sounds like manslaughter to me, based on the very little evidence that is available. (and, no, I don't consider any opinions Harr posts as evidence). If Mangum goes to trial, I think it will be manslaughter, maybe with more prison time. Hard to figure how the state could prevail with a higher level charge. One thing for certain, Mangum IS going to be held accountable for killing Daye.; April 18, 2013 at 6:21 AM
