NC Court of Appeals: Justice v. Law in two cases

IMPORTANT POST ABOUT JUSTICE VERSUS RULE OF LAW!!

This blog entry will require a bit of reading as it contains two of my motions as well as a prologue and epilogue. It is about the important issue of what decision a court makes when justice is confronted by the rule of law. Which way should the ruling go? Should strict adherence to technicalities of the law be followed instead of a ruling based on fairness, merit of the case, and overall justice?

In my case example in this post, the NC Court of Appeal ruled based on justice rather than the rule of law when it considered my Motion for Publication despite the fact that by law my motion should have been disqualified because it failed to meet the filing deadline. Had the Court instead chose to rule on law, it would've simply denied my Motion to Extend Time for Filing and determined the Motion for Publication to be moot.

The real question has to do with how the NC Court of Appeals will rule when it comes to Mangum's appeal of Judge Thompson's ruling to dismiss Mangum's malicious prosecution complaint based solely on strict adherence to the rule of law... a ruling that clearly lacks justice.

Would be interested in all opinions regarding justice versus rule of law, especially in my libel-defamation complaint against WRAL-5 News and in Mangum's appeal of her malicious prosecution ruling. How do you predict the NC Court of Appeals will rule in Mangum's case... on the side of justice or the law? (Actually, what is proposed is an over-simplification as Mangum's argument against the timeliness defense is ground in merits of the case as well as the law (e.g., fraud waives standard accrual of the statute).)

It is probably no surprised that I always place justice over the rule of law.

Dr. Harr -- I don't know if this has any bearing in the Crystal Mangum case, but I just read on the WCNC (Charlotte, NC), website that on Friday, the Supreme Court threw out Curtis Flowers' murder conviction - citing racial bias because prosecutors removed 41 of 42 prospective black jurors over the course of his six trials.

Sid started the countdown when he made his predictions that something would happen on or around July 4 and that Mangum would be released before the end of July. I am simply keeping track of them in a dispassionate and neutral manner. Had Sid not made his predictions there would be nothing for anyone to keep track of.

I have not said or done anything disparaging.

If anyone is cynical, it is you. You seem awfully cynical about Sid's chances of meeting his self imposed deadlines.

The only way anyone could possibly believe that my countdown is being done with "actual ill-will" (as opposed to what? Hypothetical ill-will?) and to mock at or scoff Sid, is if they know that Sid is and always was doomed to fail and that no reasonable person would believe he had any chance of succeeding. Otherwise my countdown would be no different than countdowns that are routinely done before birthdays, anniversaries, Christmas or New Years, or to mark the coming of some other big event. And you would be eagerly anticipating the embarrassment that would be visited on me when Sid's Endgame Package takes effect and Mangum is released from prison (as said has assured us will happen before the end of this month).

You aren't saying Sid is full of bullcrap and everyone knows it, are you, kenny? Because it sure sounds like you are.

Dr. Harr - My apologies for not responding sooner. Work and a busy 4th of July traveling (back to NC with family over the holiday!) has kept me away until now.

Just a few things of note-
My letter to AG Stein was really nothing more than a boilerplate letter modified to bring attention to the Ronnie Long case, and to state that we North Carolinians have an expectation he do what is right and just - and that is to free Ronnie Long. With that said, I’ll track down a copy and post it here when I get a chance. I’m not emailing it, as I don’t give out my personal email to people I don’t know, and my work email is strictly for work.
You stated Ms. Mangum’s case: “...is intertwined with other issues, such as my treatment by the media and the court issues with which I give her assistance.”
From what I’ve read on this blog, her case is ONLY intertwined with your “treatment by the media” when you have made it so yourself. That is your doing- not the media nor Ms. Mangum.
This is also true with the “court issues”. YOU chose to practice law without a license - even warned against it, IIRC. Did you let Ms. Mangum know that it was illegal before you chose to do so? If she agreed to continue, well then, yeah. I can see why that is intertwined with her case - poor decisions by both of you were bound to make that happen.

There are ways for Ms. Mangum to get some relief. I noted that Nana Duffuor helped raise money so her children could visit, for example. That is the type of real, “on the ground” work Ms. Mangum needs at present. I find it sad and unfortunate that someone on the west coast has to do this, while nothing I find similar to this is being done here in her home state.

Okay, 1 final comment before I step away from my soapbox. For those of you that have taken the time to read the information about the Ronnie Long case, if you believe (as I do) that a true injustice has been done, please show your support by signing the petition (yes, I KNOW you have to give your email address :) Just flag all emails from MoveOn as junk mail, or create a rule to automatically delete them).

I agree that not all statements should be taken concretely. Often comments are used rhetorically and/or facetiously. And, of course, some comments merely reflect opinions and are therefore neither true nor false.

Hey, Ronnie Long Supporter.

Heard about Curtis Flowers' case recently, too. It's so tragic that relief for such horrific injustice takes so long. It's as though the system is purposely dragging its heels. Charles Ray Finch is another wrongly convicted inmate recently released after serving more than forty years in prison.

Still no word on Ronnie Long's case with the Fourth Circuit. I think it's tragic that the NC A.G.'s Office is fighting against Mr. Long. I appreciate your efforts on his behalf. Because Ronnie Long has such strong support and from many different sources, I feel my energy is better expended on Mangum's case because her support has been limited and much of it is hidden underground.

Keep advocating for Mr. Long. Hope one day you'll consider fighting for Crystal Mangum.

Several of my anticipated actions have ended up as duds. I still believe that appreciable progress is still possible, and that Mangum's release is a distinct possibility before the end of the month. Yes, there's been some recent disappointments, but the possibilities still remain promising. So don't be surprised with Mangum's release this July.

Hey, Ronnie Long Supporter.

The media tries to discredit me every chance it can get. This includes telling lies, such as those by WRAL-5 News. Truth is that my 2011 lawsuit against Duke University, et al. was not about the 2006 Duke Lacrosse case, but rather about the 2010 discrimination incident in which there was a premeditated attempt to have me arrested for being a Nifong supporter and for being black.

In perpetuating the Duke Lacrosse Myth, I, like Mangum, Nifong, and others on the prosecution side of that case, have been targeted by the mainstream media. My efforts to help Crystal Mangum receive justice further enrages the media to attack me.

Regarding practice of law, I do what I can to help Mangum as a last resort. Crystal and I have both sought legal representation after she was abandoned by the NC Prisoner Legal Services in January 17, 2017. I've tried to get representation for her by the NAACP, ACLU, and many innocence projects... all without any success; and many refusing to even discusse her case with me. So, whatever legal assistance I give is as a last resort. The State Bar understands this and that is why they have not interfered.

Nana Duffuor's contributions are appreciated and helpful. She's a fantastic friend and advocate for Crystal, which can in large measure be attributed to the unfortunate history they both share. Although many individuals from North Carolina, and even Durham, may want to help Crystal, they may not know how. My particular talents enable me to work in ways that may not seem conventional.. but I believe they are effective despite lack of substantive results. DeBecker's elements of prediction can help us figure out the likelihood of a prediction actually occurring:
1. Measurability - How measurable is the outcome you seek to predict?
2. Vantage - Is the person making the prediction in a position to observe the pre-incident indicators and context?
3. Imminence - Are you predicting an outcome that might occur soon, as opposed to some remote time in the future?
4. Context - Is the context of the situation clear to the person making the prediction?
5. Pre-Incident Indicators - Are there detectable pre-incident indicators that will reliably occur before the outcome being predicted?
6. Experience - Does the person making the prediction have experience with the specific topic involved?
7. Comparable Events - Can you study or consider outcomes that are comparable- though not necessarily identical- to the one being predicted?
8. Objectivity - Is the person making the prediction objective enough to believe that either outcome is possible?
9. Investment - To what degree is the person making the prediction invested in the outcome?
10. Replicability - Is it practical to test the exact issue being predicted by trying it first elsewhere?
11. Knowledge - Does the person making the prediction have accurate knowledge about the topic?...…………………………...………. Dr. Harr is affirmative on all these elements

What he fails to note is that Gavin de Becker was writing specifically about organizational risk management. That is, risk management as it pertains to:

Organizational HR
— Ensuring that appropriate risk management steps are followed through the hiring and firing process
— Preventing employee burnout

Personal protection
— Predictable warning signs of high school shootings
— “Gut feeling”

And so on...Most definitely not about legal predictability.

He’s quoting de Becker out of context - “proof texting”, as it were. IIRC, the book this was taken from is “The Gift Of Fear”, and when read as a whole, does not support the argument he’s making.

I agree with the prior posters that Dr. Harr fails to meet criteria 8, 9 and 11.

In addition, I believe he also fails 4, 6 and 7.

4. Dr. Harr fails to understand the legal context for his prediction.
6. Although he has filed countless lawsuits, he has failed to win a single case.
7. This is a perfect situation in which to analyze comparable events. However, Dr. Harr refuses to consider prior legal cases that establish precedent.

kenyhyderal has provided useful information to establish whether or not Dr. Harr's prediction is likely to actually occur. Except for 4, 6, 7, 8, 9 and 11, I agree with kenhyderal that "Dr. Harr is affirmative on all these elements."

Sure they are, Kenhyderal. That's why they're used so frequently in, say Tarot readings or by Psychics.

There are actual lawyers that post here. You could ask them. If you work for a company that has it's own corporate lawyers, they MAY be familiar, but I guess it depends on the type of law -- Mergers/Acquisitions (maybe), Software Licensing (probably not so much)...

Then again, I note the the Enron collapse happened 4 years after de Becker's book came out, but I could find no source citing these elements that accurately predicted that collapse.

And no sources citing the use of these elements in criminal law.

But feel free to build those straw men.

Apologies for being away from the comment section for so long. But believe me, I've been extremely busy. Working hard to try an meet my self-imposed deadline that Abe has been counting down. I can say that I have set things in motion and now must wait for results. I am hopeful that the fruits of my labors will be born by month's end. However, even if I don't make the deadline, relief for Crystal will be forthcoming soon. I have never been more confident. Just stay tuned!

Also had to work on my own lawsuit... barely made the filing deadline for my Petition for Discretionary Review by the NC Supreme Court. It was due today, and I managed to get it filed this afternoon before the thunderstorm struck.

Now I will wait for results on both my lawsuit and my endeavors for Crystal. Will try to spend time completing the shar-video I began several weeks ago.

The Opinion on Mangum's Malicious Prosecution appeal to the NC Court of Appeals (Which was heard on May 8, 2019) has yet to be filed. It should be entered by August or September.

So, I will spend more time responding to comments now that my projects have been completed.

Hey, Anony.

I am very much aware of the efforts that kenhyderal has made to help Crystal... and they are significant. Not having discussed it with him, I do not know if he would want me to disclose the extent of his efforts.

Because we're not logistically close, it is difficult to work closely with him on Mangum's case. Besides, most of the work I do can only be done by myself. For example, there's no way anyone can really help me produce my sharlogs and shar-videos. And when it comes to letter-writing, it's just easier for me to do it myself.

So, in answer to your query, both Crystal and I appreciate the work that kenhyderal is doing on her behalf.

FND is not in violation of the kenhyderal doctrine, and his comments seem to be serious and in good faith, so I have no cause to censor his comments. Actually, I find it difficult to tell when a comment should be considered trolling.

Reginald Daye is responsible for his own death (and Duke University Hospital staff) because he assaulted Crystal Mangum to the extent she had to defend herself. Keep in mind that the stab wound she inflicted was non-fatal.

Hey, kenhyderal.

This DeBecker stuff is interesting. Never heard of it before. I have no doubt that the outcome I predict will be the release and exoneration of Crystal... the temporal issue is a little bit murky when it comes to predicting. But I believe that her release will be soon.

But let's try it another way:
Looking back over the entire history of this blog, can you point to any prediction made by Dr. Harr that was accurate? Can you point to any prediction I made which was inaccurate?

Hey, Dr. Caligari.

I am not totally objective and not without emotional investment in Crystal Mangum, however, that doesn't prevent me from approaching her situation with objectivity and as an unbiased third party.

Yes, many of my predictions have not come to fruition, however, I blame that on my beliefs that those responsible for Mangum's wrongful incarceration have a modicum of decency and humanity. Unfortunately I have under-estimated their lack thereof.

Hey, Dr. Caligari.

My approach will work... it is a lengthy process consisting of many parts. Yes, it will work, and you'll see, with many others, its success shortly. Keep in mind that I am up against some very powerful people and entities... most of them being heartless bullies. They're not the types who are willing to accept or admit defeat.

Just keep alert and you'll soon realize signs that my approach seeking justice for Crystal will be successful.
