The purpose of a pretrial hearing is primarily to expedite dispositions, discourage wasteful pretrial activities, and facilitate settlement.
It's primarily to help the judge manage the case, although the parties have an opportunity to request a dismissal or come to a settlement to the case before it goes to trial.
IIRC, typically the lawyers and judge attend this hearing. Since Mangum is representing herself (and no testimony is given), I don't think you can attend unless you're there for some administrative matter.
kenhyderal said... Et al : Be patient; I will in due course show proof. Meanwhile there is no possibility whatsoever that dhall can collect on the wager as it's much has easier for me to prove a positive than for him to prove a negative. Everyone conceded she was tested and results were provided at a later date. The only real question is when was it done. Crystal never gave blood or urine samples at any other time than her admission to DUMC.
For some reason, I was not able to directly upload kenhyderal's comment at September 16, 2022 at 1:51 PM. Although I clicked to approve multiple times, and it seemed as though it was posted, it clearly was not. First time I've had problems with this new format. Sorry about that.

Hey, dhall.
I am afraid that you are correct. I don't anticipate being allowed to participate in any conference. As it is, the entire NC Department of Justice, media, politicians, and practically everyone else doesn't want to talk to me.
In anticipation of that, I am going to try and help Mangum prepare for the conference. So far I am unaware of any response from the court regarding the motion for the expedited pretrial hearing.
Kenhyderal will keep putting of showing the proof until:
1) everyone forgets about the bet and he doesn’t have to show it. 2) DHall dies and doesn’t need to see it. 3) Kenhyderal dies before showing the proof.
@ Anonymous Don't let that happen. Keep the pressure on the both of us. I re-iterate, though, that DA Nifong turned over toxicology rersults to the Duke LaCtrosse Defence and Crystal had only given blood and urine samples upon her admission at DUMC.
Has Sid ever explained how the DHHS violated the Civil Rights Act, the 5th Amendment or the 14th Amendment?
I know the lawsuit states that Mangum's "right to have an autopsy report undergo review by the NC OMCE has been denied"...Where can I find this "right"?
The only thing I've found is that NC OCME has the authority to review autopsies, IF they chose to do so.
There is absolutely nothing I can find that shows that DHHS violated any law or that Mangum is entitled to any legal remedy.

Hey, Christine.
Thank you for your concern about my spoiled-rotten Siamese kitty-cat Adonis. I had some suspicions about feeding him canned tuna... he's a very picky eater and will only eat certain brands. Alas, for his well being I think I will follow your sound advice.
Replace "leprechaun" and "gold" with "Mangum toxicology results"
https://www.youtube.com/watch?v=K1ljOcl39PQ
Kenhyderal starts at @ 27 seconds. "Who all seen the Mangum toxicology results say YEAH!!"
Sid starts @ 1 minute (with his special Mangum toxicology results flute)
DHall starts at @1:35 minute mark. "I wanna know where the Mangum toxicology results at! Gimme the Mangum toxicology results. I want the Mangum toxicology results"
Kenhyderal -- My assertions were made based upon the information (gathered from lawsuits amd news articles) I posted on this blog. Anyone willing to do so can read them -- including you.
As I stated on September 7, 2022 at 5:52 am:
"I’ve provided sources that dispute ever claim you’re making.
Kenhyderal, The burden of proof is on you when you make these claims. You continually fail to meet that burden of proof.
Until you do, there is no reason for anyone who reads these comments to believe anything you write."
2 weeks later, you still fail to meet that burden of proof.
In the spirit of the Anonymous September 21, 2022 at 9:48 AM comment, I've changed my profile photo to an amateur sketch of what many say is what the Mangum toxicology results look like.
In Kenny’s world, “in due course” means sometime in the next decade. He believes he will win a new trial for Crystal in the Daye case and compensation from North Carolina “in due course.”
Am I sensing a double standard here. As we all know a toxicology report was evenually provided to the Duke Lacrosse Defence by DA Nifong and the drugs tested for were all negative. Crystal informed me that on her admission to DUMC from the Intake Center she had blood and urine drawn. Because Levicy checked on her SANE report that she did not do toxicology the Duke Lacrosse Defence freaked out. At her rape examination she showed no signs of impairment. On arrival at the intake she was stiil under impairment from whatever she was given in her drink. When her tests were all negative the Defence quicky dropped that line of attack.
The report Mike Nifong eventually turned over to the Duke LAX defense was the results from a toxicology test of Crystal Mangum’s hair -not blood or urine. (As a side note, had Mangum ingested GHB, it would have shown up in the toxicology results of the testing performed on her hair. See: https://www.nationaldrugscreening.com/ghb-drug-test/ )
Again, I never stated that blood/urine samples weren’t taken, As someone pointed out, that’s generally a given for any ER visit. Those samples are not used for toxicology screens, however, unless a provider specifically orders them. No provider ordered them during Crystal Mangum’s Mar 14 DUMC visit, as stated in the various news articles, reports, and in legal documents.
So where does this leave us?
Kenhyderal, are you backing out of our bet?
Just in case something happens to the comment, here’s the details of that bet from a post on 9 September:
Fair enough. We have a bet then? As gentlemen. Kenhyderal and DHall will each put forward $100 USD and if it is proven that a sample from Crystal Mangum was taken for a toxicology test the day of her visit to DUMC (14 March 2007 -- that is, "at the time she was physically assaulted"), DHall will donate it to Justice4nifong and is it's proven it was not Kenhyderal will donate it to a charity of DHall's choice.
Before you make up your mind - Are you sure this proof shows specifically that blood/urine samples were taken for a toxicology test or that a toxicology order was placed?
Think about it carefully before you accept the bet. September 9, 2022 at 2:06 PM
Yes, we all know that DA Nifong complied fully with his legal and professional duties to turn over to the Duke LaCrosse Defence the toxicology report and the other relevant material in his files. The disbarment proceeding before the State Bar was a kangaroo court and there was no evidence to support the holding that DA Nifong was in criminal contempt of court. Please set the record straight with the Duke LaCrosse Apologists.
Guiowen said: "So, Kenny, What's your story? Was she or was she not under impairment?"------- She was obviously under impairment from the date rate drug she was nefariously admistered at the Duke Lacross Spring-break bash; probably chloral hydrate, prior to a sexual assault, which had, as is it's want, completely worn off by the time she reached DUMC. It was not tested for at DUMC but the more common and easily tested for GHB was and found negative as was cannabis, cocaine and heroin. Levicy noted no signs of impairment
Kenhyderal— It is now more than 15 days from our bet. “In due course” is no longer an acceptable response for the production of your so-called “proof”.
I am willing to let you state a date that the proof must be delivered by. Are you willing to set one?
Kenhyderal -- I have no idea what you mean by the date applying to me.
I've posted the reasons why I think the toxicology test wasn't performed on Mar 14th, along with several quotes and links to back up why I think this is true.
Look at the bet -- "...if it is proven that a sample from Crystal Mangum was taken for a toxicology test the day of her visit to DUMC (14 March 2007 -- that is, "at the time she was physically assaulted"),.."
That's it. Nothing to do with me "not proving" anything, nothing to do with "impairment", nothing to do with when Nifong sent the toxicology results to the defense attorneys (which. I'll point out again, were the results from a toxicology test performed on her HAIR, not the results of either urine or blood).
I don't have to prove anything. You accepted the bet, you say you have proof. Provide it by October 31st (that gives you 6-7 weeks, surely enough time for someone so adamant that the can provide the proof "in due course").
If you can provide a reasonable excuse why you cannot provide the proof by that time, we can discuss it, privately, if you prefer -- Dr. Harr has my email information.
Otherwise, you've lost the bet. It truly is that simple.
l'll accept your deadline date of Oct. 31 and will await, with great anticipation, your proof that DUMC did no toxicology tests on Crystal Mangum upon her admission from the Intake Centre and the negative toxicology report provided by DA Nifong to The Duke Lacrosse Defence was from some other date and some other place with no relevance to her charge of being sexually assaulted. Good luck on that. I think no such proof exists, however my proof, although difficult to obtain, does exist in confidential medical and legal records. It's my assumption that to be "declared" the Winner "proof" has to be produced.
"..if it is proven that a sample from Crystal Mangum was taken for a toxicology test the day of her visit to DUMC (14 March 2007 -- that is, "at the time she was physically assaulted"),.."
I don't have to provide proof, but since you insist:
MCFADYEN et al v. DUKE UNIVERSITY et al (para. 302-311): http://dig.abclocal.go.com/wtvd/dukeplayerslawsuit_pt2.pdf (beginning at page 103)
Herald-Sun: “Medical records of the alleged victim in the Duke lacrosse rape case suggest she might not have been tested for drugs or alcohol, according to a defense filing Monday...
…The nurse who filled out a report on that exam indicated no toxicology tests were performed, according to a defense motion filed Monday….
…Defense attorneys said there was no toxicology information contained in the 1,278 pages of evidence turned over by the DA's office last Thursday, May 18th.”
WRAL.com reported: "If there was a toxicology report available, it would've been included in the discovery I handed over to the defense," Nifong told WRAL on Monday.
Nifong told WRAL he had turned over all the evidence he has to-date and that when any new reports or documents come in, they too, would be handed over to the defense
Newsweek: "...Nifong had "hinted" that a date rape drug may have been used in the alleged rape. A urine toxicology test was not performed when Mangum was examined in the emergency room March 14, hours after the party. Bradley Bannon, one of Dave Evans' attorneys, says Nifong did not say what drugs the laboratory tested for."
So you have my proof -- Lawsuits, reports from a number of legitimate news sources.
If you have a problem with these sources, by all means contact them.
IF a hair sample from Crystal Mangum was taken for testing at any time around March 14 2006, the results would have been in included in the discovery turned over to defense attorneys in May.
Since the toxicology data wasn't turned over to the defense until August, it's obvious that the hair sample taken for testing occurred well after March 14.
I have no idea what you are stating here Kenhyderal.
The bet was to prove that there was a toxicology test performed March 14. The burden of proof is yours - There was no condition of that bet that I prove anything.
The information I’ve shared is simply because you stated “l'll accept your deadline date of Oct. 31 and will await, with great anticipation, your proof that DUMC did no toxicology tests on Crystal Mangum upon her admission…”
You’ve got a month to share your proof. I eagerly await it.
@dhall: First, you propose a deadline for presenting factual proof of my assertion, while stating your assertion doesn't need to be proven. Then, a month before the deadline you proposed and I accepted, you set out a series of things that you believe altready prove, definitively, your assertion. It's composed of The Duke Lacrosse statement of claim, in theire Lawsuit agains Duke Universiy, with it'1080 points of claim and in media reports relyining heavily on the checked box by SANE Nurse Levicy saying that she did no toxicology. Durham Police and DA Nifong, though, did believe there was evidence Crystal had been illegally drugged. The defence had a different interest in fostering the idea that Crystal arrived at the Party impaired by drugs and was too intoxicated to give an account of any sexual assault. When they discovered that she had no illicit drugs in her system they quickly dropped that line of attack and, something like you, began promoting the line she was intoxicated but was never tested
Your post @ September 28, 2022 at 8:43 AM basically restates a previous one, and I still have no idea what you're trying to say.
But here goes:
"First, you propose a deadline for presenting factual proof of my assertion, while stating your assertion doesn't need to be proven." Yes, that is correct. The bet clearly states "if it is proven that a sample from Crystal Mangum was taken for a toxicology test the day of her visit to DUMC..". My argument is that there is no proof of a toxicology test from March 14, 2006.. You accepted the bet, therefore the burden of proof is on you to prove there was.
"Then, a month before the deadline you proposed and I accepted, you set out a series of things that you believe altready prove, definitively, your assertion." Yes, that is true, although I have no idea why you felt the need to restate it.
"It's composed of The Duke Lacrosse statement of claim, in theire Lawsuit agains Duke Universiy, with it'1080 points of claim and in media reports relyining heavily on the checked box by SANE Nurse Levicy saying that she did no toxicology. Durham Police and DA Nifong, though, did believe there was evidence Crystal had been illegally drugged." It's composed of more than you state, as well you know. I make no claim on what the Police or Mike Nifong believed. I made the claim that the toxicology test was not performed at DUMC on 14 March 2006. Neither the police nor the DA can order a toxicology test.
"The defence had a different interest in fostering the idea that Crystal arrived at the Party impaired by drugs and was too intoxicated to give an account of any sexual assault. When they discovered that she had no illicit drugs in her system they quickly dropped that line of attack and, something like you, began promoting the line she was intoxicated but was never tested" I made no claim regarding the defense's interests. With regards to the toxicology test, even Mike Nifong is quoted (in July 2006) of saying that no toxicology report exists. If no report existed in June 2006, it stands to reason it didn't exist on or after Mar 14, 2006.
Is that referencing your post @September 28, 2022 at 8:43 AM?
If so, you should try again. "altready" "theire" "agains" "Universiy" "with it'1080" "relyining" "defence" (OK -- that may be the correct spelling in Canada..IDK)
dhall said: "The bet was to prove that there was a toxicology test performed March 14. The burden of proof is yours. There was no condition of that bet that I prove anything." ---------- No, the bet was to prove there was, or was not, a Toxicology Test and the burden of proof is on both parties, to the wager, to prove, their contention.
dhall, Kenny never lies. He told me so himself. The trouble is that, because of context, he misunderstands half of what others tell him, and forgets half of what he himself says. So please don't use the ad hominem attack "you are a liar".
@ dhall; I said: "Then, a month before the deadline you proposed and I accepted, you set out a series of things that you believe already prove, definitively, your assertion." You replied "Yes, that is true".---------- My reply to that response is, " No. it is not true".
Kenhyderal -- Let's completely disregard the information from the lawsuit (we shouldn't but for the sake of argument, let's do so).
I've got reports from various reputable news sources (Herald-Sun, WRAL, Newsweek) stating that either no toxicology test was performed while Crystal Mangum was at DUMC, or that no toxicology report was available in May 2006 -- 2 month after the alleged rape.
I've got Mike Nifong quoted (from June 2006 --you can watch it) stating that no toxicology report exists. Mike Nifong is, as we know, a true Minister of Justice. He would only make this statement if he believed it to be true at the time.
I've also pointed out the the toxicology test eventually turned over to the Duke LAX defense was from a hair sample, and wasn't turned over until around August 2006. Well after the June Nifong quote.
“ @ dhall; I said: "Then, a month before the deadline you proposed and I accepted, you set out a series of things that you believe already prove, definitively, your assertion." You replied "Yes, that is true".---------- My reply to that response is, " No. it is not true". “
What’s not true? I proposed and you accepted a deadline.
I set out a series of things, (articles and lawsuit data.)
I believe the the information I set out proves my assertion.
If kenny gets to determine what is or isn't proof, he's never going to accept anything you offer as proof, regardless of who/where the statement came from.
It really is that simple, and speaks to the type of person Kenhyderal truly is.
If you disagree with or criticize his personal truth you criticize him. After all, he is the one who determines truth, so a difference in belief is a personal affront.
Kenhyderal - Crystal Mangum from her book, “The Last Dance For Grace: The Crystal Mangum Story” (page 32):
“There are also no toxicology reports from that night [Mar 13-Mar 14], either. To the best of my knowledge no such test was performed when I went to the hospital…Performing a toxicology test is one of the things I wish had been done as part of the investigation “
Dhall, I applaud you for actually reading Crystal Mangum's book. So far, you're the only person I know that's admitted to doing so. I'm quite frankly shocked that Kenny wasn't aware of this before he agreed to the bet.
Kenny -- Will you prove ME wrong, and accept the words of Crystal Mangum herself as proof that no samples were taken from her for a toxicology test on March 14?
@dhall: Crystal, in The Last Dance for Grace, reacted to the widely promoted, with feigned outrage, revelation that nurse Levicy, in her SANE report, checked off that no toxicology was done. I have it, though, from a good source that, as part of a routine protocol for patients brought to DUMC from the Intake Center, a drug screen was done, with negative results and that there are Hospitsl Records to that effect. I also have it on good authority that at some point DA Nifong obtained these records prior to Cooper taking over.
I don’t think I’ve read about Mangum v. Buffaloe. It’s already in appeal? Seeking relief under 42 U.S.C. § 1983 is common. I’m not a medical expert, but if there was ever a reason to seek a lawyer, this would have been one.
Honestly, Dr. Harr, this is an unfortunate situation that you’ve exacerbated by filing all those frivolous lawsuits.
Kenhyderal- “Crystal, in The Last Dance for Grace, reacted to the widely promoted, with feigned outrage, revelation that nurse Levicy, in her SANE report, checked off that no toxicology was done.”
I accept her comments at face value. Am I correct in thinking you don’t?
I have it, though, from a good source that, as part of a routine protocol for patients brought to DUMC from the Intake Center, a drug screen was done, with negative results and that there are Hospitsl Records to that effect.
I found it rather callous that your good source is aware of a toxicology test that Crystal Mangum only wished existed. Why didn’t your good source share this information at the time?
I also have it on good authority that at some point DA Nifong obtained these records prior to Cooper taking over.
I have it on good authority that Mike Nifong had a toxicology test performed on hair samples and turned the results of that test over to the defense in August 2006.
I’ve met my obligations to prove no toxicology test was performed.
It’s time you put your “good source” to work and show us your proof.
Your poor attempt at proof texting her statement completely ignores the first sentence, “There are also no toxicology reports from that night either.”
Between WRAL quoting Mike Nifong saying in June 2006 that no toxicology report exists, and Crystal Mangum stating the same in her book, I’ve provided all the proof I need. They are inarguably the 2 people who know the most about it, and they are more reliable than any source you’ve provided.
Kenhyderal- Why do you refuse to answer any of my questions?
I’ll list them here to save you from scrolling back.
You stated: “Then, a month before the deadline you proposed and I accepted, you set out a series of things that you believe altready prove, definitively, your assertion." When I respond that this was a true statement, you said it’s not. What’s not true about it? If it’s not true, why did you make the statement in the first place?
When a quoted Crystal Mangum from her book, I asked: Is she lying?
I stated: “I accept her comments at face value.” Am I correct in thinking you don’t?
I stated: “ I found it rather callous that your good source is aware of a toxicology test that Crystal Mangum only wished existed.” Why didn’t your good source share this information at the time?
Please take the time to actually answer these questions.
Why are you continuing to embarrass yourself? You have been caught in another one of your lies. Refusing to admit that just makes you look like a bigger fool.
dhall said:" When I respond that this was a true statement, you said it’s not. What’s not true about it? If it’s not true, why did you make the statement in the first place?............. You may believe that the series of things you set forth prove your assertion; that much is true, however the real question is do they actually prove what you suggest and I know the answer to that is they do not. I, as well as former DA Nifong, know toxicllogy was done by DUMC on admission, so it was in fact shared. What confuses the issue is in the SANE report, on the rape examination done by Dr. Manley and Nurse Levicy, it was checked to indicate they did not order a toxicology report. Some of the reason for this is that Crystal did not show any signs of impairment at that time. In the book Crystal expressed the wish they had. DA Nifong was still convinced that Crystal had been drugged and the later hair tests were an attemt to find evidence of that. Unfortunately the probable drug used is quickly metabolized by the body. It did dispell the notion though that Crystal was an illegal drug user.
@ A Durham Man: I entered into the wager sure and certain that, without a double standard in effect, there was no way dhall could prove that something that happened didn't happen. I knew it might be hard for me to access this confidential information. but that eventually the truth, one way or another, always comes out.
“ there was no way dhall could prove that something that happened didn't happen”
Other than provide statements from the 1 person most closely involved with this case saying it didn’t happen, and quotes from the 1 person (a true minister of justice ) who was responsible for the prosecution of the case.
Look, you don’t believe Crystal Mangum. Or Mike Nifong. I get it. Quite frankly, I don’t believe them about a lot of things, either.
But until proof is provided stating otherwise, who else should we believe?
I guess we can add "welcher" to the long list of adjectives used to describe kenny.
Does anyone doubt that kenny is also Kilgo and, while commenting under that pseudonym, he seeded this blog with disinformation to support his ridiculous claims and advance his false narratives?
dhall, never, ever engage kenny. He is a dishonest troll, a liar and, now, a welcher.
Funny how Kenny believes everything Crystal Mangum has stated about the Duke LAX case, EXCEPT when she states that there are no toxicology reports from that night. Why is that?
DHall's provided all the proof I need to believe him. Why should we believe Kenny?
"@ A Durham Man: I entered into the wager sure and certain that, without a double standard in effect, there was no way dhall could prove that something that happened didn't happen."
Except that I did prove my argument with statements from Crystal Mangum and others.
You are wrong. News releases confirm you are wrong. Crystal's statements confirm that you are wrong.
Kenhyderal, October 4, 2022 - "I, as well as former DA Nifong, know toxicllogy was done by DUMC on admission, so it was in fact shared."
Who did Mike Nifong share these toxicology test results with?
May 23, 2006 - https://www.wral.com/news/local/story/1091731/
""No such toxicology report, if it exists, was provided to the defense," wrote attorneys Kirk Osborn and Ernest Conner, referring to nearly 1,300 pages of evidence prosecutors provided to defense attorneys last week...."If there was a toxicology report available, it would've been included in the discovery I handed over to the defense," Nifong told WRAL on Monday."
June 23, 2006 - https://www.wral.com/news/local/story/1055903/
"DURHAM, N.C. — Toxicology results on a woman who says she was raped were not included in an additional 536 pages of evidence that Durham's lead prosecutor handed over Thursday to three Duke lacrosse players' defense attorneys because he said no test report exists."
No toxicology reports (or even the existence of a pending toxicology report) was turned over to the defense until the results of tests on the hair was turned over in August 2006.
IF Mike Nifong knew that a toxicology test was performed (or was pending results) in March and failed to disclose it in discovery to the Duke LAX players defense, he violated his duty as a prosecutor to seek justice, not convictions.
Kenny's proving to be a waste of time, dhall. He's never going to accept the statements from CGM or Mike Nifong. He's never going to provide any proof that a toxicology test was performed at DUMC during CGM's visit.
Let it go -- he's never going to admit he lost the bet, even though everyone here (including Kenny) knows it.
@ dhall: Unlike The Duke Lacrosse Trial Lawyers, Duke Lacrosse Apologists, like you, haven't got the message. The Trial Lawyers quickly dropped that line of attack when they realized their hope to show Crystal, arriving at DUMC and claiming rape, was under the influence of drugs. Your quotes, from Crystal and from DA Nifong both referred to the SANE examination, which the Trial Lawyers had latched onto but quietly dropped when they realized there was, in fact a drug screen done by DUMC on her arrival from the Intake Center and it showed negative results. The Trial Lawyers had desperately wanted to show Crystal was high on drugs whereas DA Nifong was strongly suspicious she had been drugged with a date rape drug and wanted to pursue this aspect. It all became moot when he withdrew and then later when AG Cooper declared the Players innocent and when the Team in general lost it's money grabbing lawsuit.
Excuse the deletions. The site indicated my post did not go through and so I re-posted it several times but I see the posts indicated as unsuccessful did go through.
@ Abe Your perjorative is not very politically correct. Our blog host Dr. Harr can confirm that the historical registered poster Kilgo and subsequently all of his pretenders are not me
"@ dhall: Unlike The Duke Lacrosse Trial Lawyers, Duke Lacrosse Apologists, like you, haven't got the message. Your quotes, from Crystal and from DA Nifong both referred to the SANE examination"
No Kenhyderal -- They don't. Mike Nifong's quotes refer specifically to the existence of toxicology results when he made them.
Crystal Mangum's quotes DO NOT MENTION anything about the SANE exam in relation to the lack of toxicology results. RTFB
Kenny, Why are you worrying? I've already explained that you never lie, so technically you cannot lose this bet. In any case, it's not as if they could come after you for this $100.
Answer truthfully. Why isn't TFB a definitive source? Is Crystal Mangum lying in her book?
My other options include quotes from a true minister of justice -- why didn't you mention him?
I've identified my sources by link or by page number in Crystal Mangum's book. I stand by them. You've offered NO source, and you have until the end of the month to do so.
@ dhall: 10-8-22 3:30 Not only did Crystal say "to the best of my knowledge" but, she was relying on the SANE report where Nurse Levicy checked off that she had ordered no toxicology. That is a different matter from the real question, which is, was she screened for drugs by DUMC on her arrival from the Intake Center? DA Nifong, in responding to the Lawyers did likewise but later on he acquired the tests that were done on her arrival and he conducted further testing because at the time he strongly suspected a date rape drug was used.
@ The Price 10-9 -22 9:04: I know Crystal well enough to know she is not a liar, unlike those who sexually assaulted her or those who testified against her in the Reginald Daye case.
Crystal says: “There are also no toxicology reports from that night [Mar 13-Mar 14], either. To the best of my knowledge no such test was performed when I went to the hospital…Performing a toxicology test is one of the things I wish had been done as part of the investigation “
You keep ignoring the bolded portions of her comments. If Crystal Mangum is not a liar, then those statements are true. Being true statements, they are all the proof I need.
You say “but later on he acquired the tests that were done on her arrival”
I would like to remind the readers of your blog that they violate the kenhyderal supporter doctrine when they call kenhyderal a master debater, a master baster, a little man or a liar. All posts that mock or disparage kenhyderal will be deleted from the blog.
I also encourage you to enforce the kenhyderal supporter doctrine strictly. kenhyderal deserves to be treated with respect.
@ KHS Your concern, to say the least, is disingenuous. I am very used to Duke Lacrosse Apologist mockery and I consider the frequent resort to ad hominem attacks a sure sign they are begining to lose the once near universal acceptance of their narrative.
“Et al : Be patient; I will in due course show proof. Meanwhile there is no pssibility whatsoever that dhall can collect on the wager as it's much has easier for me to prove a positive than for him to prove a negative. “
I am shocked that you question my intentions. It pains me no end to see that posters call you a liar and insult you by calling you juvenile names. You have confirmed that these posts upset Crystal’s children and I am sure that they upset your family as well.
I am doing my best to encourage Dr. Harr to enforce the kenhyderal supporter doctrine. Please also remember that I am proud to call you my friend.

Hey, gui, mon ami.
I'm doing fine, thank you. I haven't been doing the comments recently because I have been hard at work trying to keep Crystal from spending a twelfth consecutive Christmas in prison. For a change, I feel confident that she will not only be out by the Holiday Season, but a good possibility that she will be free by Thanksgiving. Things are looking up at this time. Now, must get back to work on her case.
Sid could resolve the whole dhall/kenhyderal bet by asking CGM if she lied about the toxicology tests at DUMC in her book.
The likelihood of that is roughly the same as Kenhyderal providing his proof -- that is. it's not going to happen.
Just like CGM getting out of jail this year.
I do have a question though -- Sid says this is her 12th Christmas in jail. She wasn't sentenced until Nov. 2013. She was arrrested in April 2011. My math tells me that the most she would have been in jail this December would be her 11 years.
"I do have a question though -- Sid says this is her 12th Christmas in jail. She wasn't sentenced until Nov. 2013. She was arrrested in April 2011. My math tells me that the most she would have been in jail this December would be her 11 years.
What am I missing here, Sid?"
Answer: Christmas 2011.
If you start with Christmas 2011, this Christmas will be Mangum's 12th Christmas spent while incarcerated. It won't be her last, either.
Crystal was in jail, before sentencing, in 2011 and 2012. That's 2 Christmases. She was then sentenced in 2013 and has been in jail 9 years since then. That's a total of 11 Christmases. This one will be her 12th.
Crystal Mangum’s own words have disproved any argument Kenhyderal can make. He cannot provide his “proof” because he has none. He has 8 days, then we will see how honorable he actually is.
The post at 3:40 PM on October 23 violates the kenhyderal supporter doctrine and should be deleted. Given that the deadline for providing proof is October 31, the poster has falsely accused kenhyderal of being a welcher. As kenhyderal has told us, he will share his proof with us in due course.
dhall believes he has proven that Crystal was not given a drug screen on her admission from The Intake Center because Crystal said in her book, that to the best of her knowledge she was not tested. My source tells me she was but that in normal circumstances obtaining the recod of this is difficult, but perhaps clandestinely, not impossible. However to show my good faith, I will send to Dr. Harr $100.00 US to be forwarded by him to the Charity of dhall's choice but with the provision that when, at such time, the proof becomes known, he will also donate $100 US to Justice4Nifong.
"My source tells me she was but that in normal circumstances obtaining the recod of this is difficult, but perhaps clandestinely, not impossible."
Your source would only have access to this information if they are a DUMC employed healthcare provider or IT resource.
If, by "clandestinely", you mean without CGM's written permission, accessing this information violates federal law ,and your source providing this data is risking their job.
Generally speaking, CGM's medical records can only be shared with those she identifies as involved with her health care (or health care bills). This could include immediate family, relatives, or friends..and then only after her written permission.

Bold claim, Sid…But one you’ve made multiple times, with no success.
Care to enlighten us what makes this claim so different from all the others?
October 24, 2022 at 4:43 AM
Hey, Prince Humperdinck.
I believe that there is positive movement, unlike never before that bodes extremely well for Crystal Mangum. The ensuing two or three months should be revealing.
Are you working on a secret project that will result in Crystal’s release?
October 26, 2022 at 4:12 AM
Hey, Nifong Double-Supporter.
There is a particular area in which my attention has been focused for some time and I believe it very likely will result in Mangum's release. I wouldn't exactly call it secret, but I won't jinx it by discussing it. If all goes well, I would hope to see Crystal freed before Turkey Day.
Anonymous Prince Humperdinck said... We know Sid isn't Kenny's "source". In order to get to CGM's medical records, Sid would have to enter DUMC, which is on the Duke University campus.
IIRC, Sid's vowed never to enter the DU campus again (even to see his friend, James Coleman). The potential for Sid's kidnapping is just too high.
Sid would never risk getting kidnapped with CGM getting out of prison in 30-60 days.
October 25, 2022 at 3:24 PM
Hey, Prince Humperdinck.
I did vow never to knowingly set foot on Duke University property after the failed attempted kidnapping of April 14, 2010. However, I did break that vow on a couple of occasions. One was to visit a friend at a Duke University Hospital in Raleigh who was hospitalized for surgical treatment of esophageal cancer. The second circumstance had to do with visits to Duke University Hospital in Durham to obtain medical records about Crystal's 2006 emergency room visit which was requested by freelance writer Justin Glawe, who told me he was going to write a story about Crystal for a tenth anniversary March 2016 article in The Daily Beast and present the truths of her case... but insisted on having the hospital records beforehand. I sent him the records, and never heard back from him. Instead of a story by Glawe, another tenth anniversary story was written for The Daily Beast by someone with whom I never communicated. The article never touched upon the truths of Mangum's innocence... (i.e., the esophageal intubation, the elective removal from life-support, etc.) I clearly felt betrayed not only by Justin Glawe, but by The Daily Beast.
I don't recall sharing Mangum's hospital records with anyone other than Glawe.
Are the people you are dealing with and relying on to execute your not exactly secret plan aware of your deadline? Is the prison system and/or any court aware that Mangum is about to be released? If not, you probably should let them know. They usually require advance notice of such things so they can prepare the necessary paperwork and notify the appropriate parties.
I believe you are either delusional or you are gaslighting us and Mangum. Possibly both. We shall soon find out if I am right.
I’ve not heard from either Kenhyderal or Dr. Harr.
Perhaps Kenhyderal is waiting for Dr. Harr to confirm he has the medical records from Crystal Mangum’s ER visit and that these records contain the toxicology reports from that visit.
I'm a senior citizen who believes that the state of North Carolina has harshly, excessively, and unjustly treated former Durham District Attorney Mike Nifong.

Et Al: Be patient; kenhyderal is waiting to receive the proof from Kilgo’s friend who works at Duke Hospital.
Right on kennyhyderal.
Of course DHall will never collect on the wager.
Read the bet, Kenhyderal. If the toxicology test wasn’t performed on the 14tn of March, you lose.
I agree with kenhyderal. DA Nifong turned over everything in his files to the Duke LaCtrosse Defence.
kenhyderal will keep the pressure on Kilgo’s friend.
Welcome to the party, Mike N.
I have yet to receive any proof from Kenhyderal.
Kenhyderal, you can get my contact information from Dr. Harr.

Kenny,
Where is the proof?
Kenhyderal-
Well? We’re waiting!
Kenny,
Show us the proof.
Enjoy.
Kenny,
When should we expect to see your proof? What is the reason for the delay?
In due course. b.t.w. Both I and dhall made assertions. Anyone interested in seeing his "proof"?
Kenhyderal -- My assertions were made based upon the information (gathered from lawsuits amd news articles) I posted on this blog. Anyone willing to do so can read them -- including you.
As I stated on September 7, 2022 at 5:52 am:
"I’ve provided sources that dispute ever claim you’re making.
Kenhyderal, The burden of proof is on you when you make these claims. You continually fail to meet that burden of proof.
Until you do, there is no reason for anyone who reads these comments to believe anything you write."
2 weeks later, you still fail to meet that burden of proof.
The Crichton leprechaun!! Thanks, Anonymous.
I'd completely forgotten about this.
When's Crystal getting out of jail? I recall you promising an early release for years, yet it never happens. Any promises of early release?
LOL
You're welcome.
"I've changed my profile photo to an amateur sketch of what many say is what the Mangum toxicology results look like."
Well played, dhall. Well played.
No, Kenny, you're not sensing a double standard. You're sensing the fact that you're losing the bet.
Dhall -- if you haven't selected a place for Kenny's donation, I suggest any of the those you can find at https://winred.com/
So, Kenny,
What's your story? Was she or was she not under impairment?
Kenny,
Yes, we all know that DA Nifong complied fully with his legal and professional duties to turn over to the Duke LaCrosse Defence the toxicology report and the other relevant material in his files. The disbarment proceeding before the State Bar was a kangaroo court and there was no evidence to support the holding that DA Nifong was in criminal contempt of court. Please set the record straight with the Duke LaCrosse Apologists.
I’m proud to call kenhyderal my friend.
Kenny,
Other than statements that you claim Crystal made to you, what evidence do you have to support your post at 4:12 PM on September 22?
Rock steady, Kenny.
You have the testimony of the people that saw and/or treated Crystal Mangum. You have her significant prescription drug history.
Then you have Kenhyderal’s stories that ignore both.
Chose to believe what you will.
Kenhyderal- Why Am I still waiting for your “proof” ?
I’ll give you until the end of October. After that, you will be declared the loser of the bet - unless you can give a reasonable excuse for the delay.
@ dhall: Pick your date any date but keep in mind that date applies to you as well as me.
So, Kenny,
What you are saying is, you have no proof that she was impaired, but you have an excuse for your lack of proof.
It's my assumption that to be "declared" the Winner "proof" has to be produced.
kenhyderal’s post at 4:12 PM on September 22 is completely accurate.
Kenhyderal -- That wasn't the bet.
http://dig.abclocal.go.com/wtvd/dukeplayerslawsuit_pt2.pdf
(beginning at page 103)
Herald-Sun:
“Medical records of the alleged victim in the Duke lacrosse rape case suggest she might not have been tested for drugs or alcohol, according to a defense filing Monday...
…The nurse who filled out a report on that exam indicated no toxicology tests were performed, according to a defense motion filed Monday….
…Defense attorneys said there was no toxicology information contained in the 1,278 pages of evidence turned over by the DA's office last Thursday, May 18th.”
WRAL.com reported:
"If there was a toxicology report available, it would've been included in the discovery I handed over to the defense," Nifong told WRAL on Monday.
Nifong told WRAL he had turned over all the evidence he has to-date and that when any new reports or documents come in, they too, would be handed over to the defense
Newsweek:
"...Nifong had "hinted" that a date rape drug may have been used in the alleged rape.
"...with no relevance to her charge of being sexually assaulted."
Where did that come from? This statement was never in the bet.
provide your proof or admit you don't have it.
A quick note -- drug testing on hair is turned around rather quickly:
A negative result can be determined within 24 hours of hair removal.
A positive drug test is confirmed after 72 hours (if it's positive, it goes through additional gas chromatography testing).
(see: https://www.healthline.com/health/hair-follicle-drug-test#_noHeaderPrefixedContent)
More proof, Kenhyderal:
https://www.wral.com/news/local/video/1055904/
(Jun 24, 2006 )
"DA Mike Nifong says no toxicology report exists..."
Deleted a post full of typos and re-posted it
Your post @ September 28, 2022 at 8:43 AM basically restates a previous one, and I still have no idea what you're trying to say.
But here goes:
"First, you propose a deadline for presenting factual proof of my assertion, while stating your assertion doesn't need to be proven."
Yes, that is correct.
"Then, a month before the deadline you proposed and I accepted, you set out a series of things that you believe altready prove, definitively, your assertion."
Yes, that is true, although I have no idea why you felt the need to restate it.
"It's composed of The Duke Lacrosse statement of claim, in theire Lawsuit agains Duke Universiy, with it'1080 points of claim and in media reports relyining heavily on the checked box by SANE Nurse Levicy saying that she did no toxicology. Durham Police and DA Nifong, though, did believe there was evidence Crystal had been illegally drugged."
It's composed of more than you state, as well you know.
When they discovered that she had no illicit drugs in her system they quickly dropped that line of attack and, something like you, began promoting the line she was intoxicated but was never tested"
I made no claim regarding the defense's interests. With regards to the toxicology test, even Mike Nifong is quoted (in July 2006) of saying that no toxicology report exists. If no report existed in June 2006, it stands to reason it didn't exist on or after Mar 14, 2006.
Kenhyderal -- Just show your proof. Once that's done, you win your bet.
Seems pretty easy to me.
"Deleted a post full of typos and re-posted it"
Is that referencing your post @September 28, 2022 at 8:43 AM?
If so, you should try again.

dhall said: "The bet was to prove that there was a toxicology test performed March 14. The burden of proof is yours. There was no condition of that bet that I prove anything." ---------- No, the bet was to prove there was, or was not, a Toxicology Test and the burden of proof is on both parties, to the wager, to prove, their contention.
dhall,
Kenny never lies. He told me so himself. The trouble is that, because of context, he misunderstands half of what others tell him, and forgets half of what he himself says. So please don't use the ad hominem attack "you are a liar".
kenhyderal,
Will Kilgo’s friend who works at Duke Hospital be able to provide you the toxicology report?
@ Nifong Supporter: Did my reply to dhall's post of 4:04 AM 9-28-22 go astray?
What more do you need?
Kenny,
Where is the proof?
Kenny,
Show us your proof or stop wasting our time.
I believe the the information I set out proves my assertion.
kenny,
Well played, sir! You have dhall right where you want him. Show your proof and win the bet! Prove to everyone that you are not a liar and a troll!
Abe Froman
Chicago, IL
dhall --
If kenny gets to determine what is or isn't proof, he's never going to accept anything you offer as proof, regardless of who/where the statement came from.
It really is that simple, and speaks to the type of person Kenhyderal truly is.
If you disagree with or criticize his personal truth you criticize him. After all, he is the one who determines truth, so a difference in belief is a personal affront.
Abe,
Please consider providing a countdown to Kenny’s October 31 deadline.
Is Crystal Mangum lying?
Wow....
Sidney Harr on Twitter (Oct 31, 2009):
"@CapeRiverMan Suggest you read "Last Dance for Grace: the Crystal Mangum Story" to find out what really happened."
If Kenny denies that the Crystal Mangum's statement is true, he's also denying Sid's statement that her book tells "what really happened".
dhall,
Good find. That statement comes from the horse’s mouth, so to speak.
Kenny,
You have some splainin to do.
Kenny,
Are we to believe that you have a secret source to go along with your secret plan?
kenhyderal,
I have a copy of the toxicology report and I need your email address so I can forward it to you.
Kenhyderal-
“Crystal, in The Last Dance for Grace, reacted to the widely promoted, with feigned outrage, revelation that nurse Levicy, in her SANE report, checked off that no toxicology was done.”
I have it on good authority that, unlike DHall, Kenny has no proof of any of his statements.
Kilgo’s Friend,
If you email the toxicology report to justice4nifong@gmail.com, Dr. Harr will forward it to kenhyderal.
Kenny -
Your good source is a better source than Crystal Mangum?
Interesting.
Kenny
I eagerly await your proof that Crystal Mangum lied about the events of March 14th in her book.
Kenny,
Just explain to them WHY your sources are impeccable. You'll win the bet!
Oh, Kenny!
You have it from a good source that as part of a routine protocol for patients brought to DUMC from the Intake Center, a drug screen was done.
DHall has it from a better source, Crystal Mangum herself, that it wasn’t.
Should we believe CGM, or your unnamed source?
Why do you believe CGM is absolutely truthful about everything else that happened that night, but lying about this?
Kenhyderal --
Well? We're waiting!
Kenhyderal --
You'll get nothing and like it!
Kenhyderal --
I'm confident I've met my requirements for our bet. Do you agree? If not, what more information could you possibly need?
Crystal said: "To the best of my knowledge no such test was performed when I went to the hospital"
Come on, Kenny, you can do better than that.
Now it’s your turn, and the clock is ticking.
If Crystal Mangum says “to the best of my knowledge…”, who do you expect has better, more accurate information?
DHall’s won this bet, and you’re doing your best to weasel out of it.
Time to put up or shut up.
I am intrigued, Kenhyderal.
How long have you known that the toxicology tests were performed when Crystal Mangum was brought to DUMC from the intake center?
Kenhyderal- Why do you refuse to answer any of my questions?
I’ll list them here to save you from scrolling back.
You stated:
“Then, a month before the deadline you proposed and I accepted, you set out a series of things that you believe altready prove, definitively, your assertion."
When I respond that this was a true statement, you said it’s not.
What’s not true about it? If it’s not true, why did you make the statement in the first place?
When a quoted Crystal Mangum from her book, I asked:
Is she lying?
I stated:
“I accept her comments at face value.”
Am I correct in thinking you don’t?
I stated:
“ I found it rather callous that your good source is aware of a toxicology test that Crystal Mangum only wished existed.”
Why didn’t your good source share this information at the time?
Please take the time to actually answer these questions.
@ Judge Smails: I never wear white after Labour Day
Kenny,
Why are you continuing to embarrass yourself? You have been caught in another one of your lies. Refusing to admit that just makes you look like a bigger fool.
Odd that you chose to respond to an obvious troll, rather than answer legitimate questions.
We can only surmise it’s because you can’t answer them.
I eagerly await your proof.
dhall said:" When I respond that this was a true statement, you said it’s not.
I’m proud to call kenhyderal my friend.
Kenny,
Is Mike Nifong your secret source?
Kenny,
Why do you continue to ignore dhall’s questions?
Kenhyderal-
You’re a piece of work.
Crystal Mangum herself stated the no toxicology test was performed.
Mike Nifong is quoted stating the same 3 months after the alleged rape.
That is proof - Mangum was physically there at DUMC. She would know. Mike Nifong had the events investigated. He would know.
You’ve offered NOTHING to prove otherwise.
It is a fact that no drug toxicology results were shared by Nifong when discovery was given to the defense in May.
It is a fact that the toxicology results turned over to the defense in August were from a hair sample.
Your argument that these facts are wrong fails when the only proof you can provide for that claim is that “you know” they are.
Abe Froman

Yet you insist you're right. Show your proof.
Otherwise you've lost the bet.
Kenhyderal, October 4, 2022 -
"I, as well as former DA Nifong, know toxicllogy was done by DUMC on admission, so it was in fact shared."
But it IS Mike Nifong, so.....
kenhyderal,
I emailed the toxicology report to justice4nifong@gmail.com. Have you received it?
Dr. Harr,
Did you receive the toxicology report from Kilgo’s Friend?
Harr can confirm that the historical registered poster Kilgo and subsequently all of his pretenders are not me
Kenny,
Why are you deleting so many of your posts? What are you hiding now?
"@ dhall: Unlike The Duke Lacrosse Trial Lawyers, Duke Lacrosse Apologists, like you, haven't got the message. Your quotes, from Crystal and from DA Nifong both referred to the SANE examination"
No Kenhyderal -- They don't. Mike Nifong's quotes refer specifically to the existence of toxicology results when he made them.
Crystal Mangum's quotes DO NOT MENTION anything about the SANE exam in relation to the lack of toxicology results. RTFB
@ dhall: If there is no definitive source available, and your only option is TFB, you are likely screwed.
Kenny,
Why are you worrying? I've already explained that you never lie, so technically you cannot lose this bet. In any case, it's not as if they could come after you for this $100.
Answer truthfully. Why isn't TFB a definitive source? Is Crystal Mangum lying in her book?
My other options include quotes from a true minister of justice -- why didn't you mention him?
I've identified my sources by link or by page number in Crystal Mangum's book. I stand by them. You've offered NO source, and you have until the end of the month to do so.
Then we'll see who's "likely screwed"
Kenny,
I beg to differ
You are screwed. You have your unsubstantiated assertions and no proof of anything.
But that’s not a surprise.
Kenny,
The citizens of Durham thank you. While you waste your time with your bet, Crystal remains in prison and Durham is a safer place.
Kenny- Present your proof, or you’re likely screwed.
CGM wrote TFB. What is more definitive than that?
RTFB is a throwback to Walt’s RTFM (Read The F***ing Manual)…
Kenny obviously thinks CGM is lying in her FB. Sid she settle this by asking CGM if she’s lying in her book.
Sid? Will you ask her and (truthfully) let us know her response?
Crystal says:
“There are also no toxicology reports from that night [Mar 13-Mar 14], either. To the best of my knowledge no such test was performed when I went to the hospital…Performing a toxicology test is one of the things I wish had been done as part of the investigation “
You keep ignoring the bolded portions of her comments. If Crystal Mangum is not a liar, then those statements are true. Being true statements, they are all the proof I need.
You say “but later on he acquired the tests that were done on her arrival”
Show your proof. You have 3 weeks.
It’s time for you to show us your proof. Have you had a chance to study the toxicology report that Kilgo’s Friend sent you?
Kenny -- If you know she isn't a liar, why are you discounting her statements in her book?
I know kenhyderal well enough to know he is not a liar.
khs,
I agree with you: kenny never lies. Unfortunately, there are reasons not to believe him.
Right on kenhyderal.
I’m proud to call kenhyderal my friend.
Kenhyderal will not show any proof because he cannot show any proof.
Finding CGM’s quotes from her book was surprising, but dhall could have gotten video statements from her and Kenny wouldn’t admit he lost the bet.
He makes statements he can’t prove. He derails any on-topic discussion, and he’s a liar.
In other words, he’s a troll. Do everyone a favor and ignore him.
Dr. Harr,
I would like to remind the readers of your blog that they violate the kenhyderal supporter doctrine when they call kenhyderal a master debater, a master baster, a little man or a liar.
Mangum’s on statements are my proof.
I’m still waiting for yours, a month later.
kenhyderal,
I am shocked that you question my intentions.
Kenny,
Where is your proof? You are a fraud.
Kenny is not a fraud. He never lies. It's just that, because of context, he forgets half of what he says, and misinterprets half of what he hears.

Sid,
This is great news. I am looking forward to another countdown by Abe Froman.
But Sidney,
You're always confident of getting her out within two weeks.
Sid,
There are 34 days until Thanksgiving.
There are 65 days until Christmas.
Abe Froman

Sid could resolve the whole dhall/kenhyderal bet by asking CGM if she lied about the toxicology tests at DUMC in her book.
The likelihood of that is roughly the same as Kenhyderal providing his proof -- that is. it's not going to happen.
Just like CGM getting out of jail this year.
I do have a question though -- Sid says this is her 12th Christmas in jail. She wasn't sentenced until Nov. 2013. She was arrrested in April 2011. My math tells me that the most she would have been in jail this December would be her 11 years.
What am I missing here, Sid?

Answer: Christmas 2011.
If you start with Christmas 2011, this Christmas will be Mangum's 12th Christmas spent while incarcerated. It won't be her last, either.

Crystal was in jail, before sentencing, in 2011 and 2012. That's 2 Christmases. She was then sentenced in 2013 and has been in jail 9 years since then. That's a total of 11 Christmases. This one will be her 12th.

Kenny,
Show us your proof. What did you mean in your earlier posts when you stated that you would provide your proof “in due course?”
We have no choice but to believe that you are a troll.
Crystal Mangum’s own words have disproved any argument Kenhyderal can make. He cannot provide his “proof” because he has none.
He has 8 days, then we will see how honorable he actually is.
Abe Froman was correct in his earlier post. Kenny has proven that he is a welcher, as well as a troll and a liar.
“ I feel confident that she will not only be out by the Holiday Season, but a good possibility that she will be free by Thanksgiving.”
Bold claim, Sid…But one you’ve made multiple times, with no success.
Care to enlighten us what makes this claim so different from all the others?
Dr. Harr,
The post at 3:40 PM on October 23 violates the kenhyderal supporter doctrine and should be deleted.

I look forward to Dr. Harr contacting me.
Dr. Harr,
I renew my request that you delete the post that falsely accuses kenhyderal of being a welcher.

Dr. Harr - You have Crystal Mangum’s medical records from her 2006 ED visit?
Kenhyderal and I have been debating the results of her toxicology reports (or lack thereof ) in those records.
Are there toxicology results in the medical record from that night?
Thanks,
Kenny,
Why don’t you ask Sid to get you a copy of the toxicology report? He will be happy to help you.

If not, you probably should let them know. They usually require advance notice of such things so they can prepare the necessary paperwork and notify the appropriate parties.
I believe you are either delusional or you are gaslighting us and Mangum. Possibly both. We shall soon find out if I am right.
