Assume everything in your packet is true (and I don't accept a lot of it, but let's assume)-- how does this lead to Mangum's freedom? She appealed and lost; filed a habeas and lost; filed a malicious prosecution case and lost. She has no legal avenues to freedom left to her short of a gubernatorial pardon.

I don't know what you're talking about. The article is chock full of factual evidence, 49 pieces to be exact, that support the statements that were made. The law is not misrepresented. Clearly, do you believe a trial or hearing of any sort, is fair if one party is denied the use of documents and references and forced to present their case by memory... as was Mangum in the Malicious Prosecution case? That is the question faced by the NC Court of Appeals. Further, regarding the law, do you believe that Judge Ridgeway is acting lawfully in denying Mangum access to the 18-page document from Dr. Nichols' personnel file that he deemed relevant to her case?

Just try to answer those two questions.

Mangum didn't appeal... her turncoat appellate defense attorney Ann Petersen appealed a single-issue that was doomed to fail. If that was the only issue I had before me as an Appellate judge, I would have similarly ruled. The Habeas Corpus case consisted of a conspiracy between the NC Attorney General's Office and an assistant clerk Debbie Blay; Mangum's case so strong that the A.G.'s Office didn't even want to file a Response to Mangum's Objection. The Federal Judge Loretta Biggs didn't even have time for a de novo review of Mangum's Objection and the Magistrate's Recommendation.

As far as the Malicious Prosecution case goes, the ruling was by a Roy Cooper appointee... replacing the initially scheduled Judge Jim Hardin. Hmmm... coincidence? I don't think so! Also, that case is not over; it's on appeal.

Hope this provides you with much needed elucidation.

Actually, you have it all wrong. My post, as well as this blog site, is one of enlightenment... something that is lacking in the mainstream media's selective, suppressive, subjective, and slanted reporting on Crystal Mangum's case. What is aired and published in the media is false and misleading.

For example, what was the cause of Daye's death? The media never answered that. The correct response is that it was the elective removal of Daye from life-support.

Another example, why was Daye removed from life-support? The media never said. The reason is because he was considered to be irreversible brain-dead.

Finally, why was Daye brain-dead? There is no medical nexus between Daye's stab wound (successfully treated with prognosis for full recovery) and his brain-death. However, there's direct correlation between the errant esophageal intubation of Daye (to treat his delirium tremens) and his brain-death.

Principal, if you would like to debate the issues specifically rather than give generalized disparaging remarks, I would welcome hearing your positions on them.

I don't agree with your premise, and I believe that a thoughtful interpretation of the law would be on my side. Medical malpractice (esophageal intubation) was the sole and independent reason that led to Daye's death, and he surely would have survived had it not occurred. The malpractice was a proximate and intervening cause of Daye's death, the direct cause being his elective removal from life-support.

I still strongly feel that there is a real possibility that Daye's death at Duke University Hospital could have been deliberate. I don't advertise it much because it is such a long leap for those who are unenlightened and naive about the sinister activities in a cruel and racist society. Furthermore, my belief is purely speculative as I have no evidence as to Daye's death being the result of premeditated actions. Rest assured, that if I had such evidence, I would have brought it attention on this site.

Hey, Dr. Caligari.

You are incorrect. Appellate defense attorney Petersen wrote the single-issue direct appeal which Crystal saw for the first time after it was filed, and it was this version by Petersen that ruled upon and denied by the NC Court of Appeals.

It was the following Petition for Discretionary Review that Petersen filed after learning that Mangum had filed her own on the last deadline date. Mangum did not want Petersen to file the PDR and did not ask her to file one on her behalf. Petersen did not file anything but a lightly edited version of her Direct Appeal.. which had already been denied. With both competing versions, Mangum asked the court to consider hers and not Petersen's.

The Habeas Corpus case was filed without Judge Loretta Biggs having the time to conduct a de novo investigation, review the Magistrate's Recommendation, analyze both arguments, and draft a well-structured Judgment and Order.

Also, the Fourth Circuit Court of Appeals reneged on its Order to allow Mangum time to file her Petition for Rehearing En Banc. Clearly she filed it within the deadline allotted, but the Court dismissed her Petition as being untimely, despite the fact that it wasn't.

Regarding picking judges... neither Mangum nor I picked Judge Jim Hardin, who was initially scheduled to preside over Mangum's malicious prosecution case. However, the Durham Court can make determinations as to the assignment of judges to cases. In Mangum's situation, the Court likely determined it most advantageous to the defendants to have the case heard before Judge Carolyn Thompson, a recent Governor Roy Cooper appointee.

As I have mentioned to you before, your story is an integral part of Crystal's. We are indebted to you for bringing it to our attention and allowing us to bring your tragic and poignant travail before the public. That takes a lot of courage.

As far as Dr. Caligari, although he may be a blow hard and is definitely a Mangum/Nifong detractor, he brings forth his views and opinions in, I believe, a serious and good-faith civilized manner. And, because he a lawyer, I appreciate his input based on his professional background. So, that's why I respond to him. I think it makes the comment section more interesting.

That's not to say that it's not refreshing and welcoming to hear positive comments from you, kenhyderal, and a few other Mangum/Nifong supporters.

Regarding the outcome: On May 8, 2019, the NC Court of Appeals is scheduled to hear Mangum's case, though she will not have the benefit of oral arguments. Actually, her case is strong enough that she doesn't really require them. I think it is a matter of months before the ruling is published. I am expecting a favorable ruling... that the lower court ruling will be reversed and remanded. So, probably the endgame will take place in a matter of a few months.

Anony, I know Nana is real (as she responded above) because I have been communicating with her for more than a year, and have met with her on multiple occasions. Not only have I written about her tragic story, which mirrored Crystal's, but Nana has visited Crystal on two occasions. Furthermore, she included Crystal's story in her multi-disciplinary sold-out engagement in Oakland last June. Nana Duffuor sent one hundred handwritten letters from Bay Area residents to Governor Roy Cooper and Crystal Mangum, and she arranged for Mangum's two oldest children to travel from southern California to North Carolina to visit with their mother during spring break a little more than a month ago.

Nana Duffuor is a real live person who has done much to advocate for Crystal Mangum and to help victims of sexual assault to not merely survive, but thrive. I am proud and grateful to know her.

So, all things considered, it seems as though the joke's on you.

Hey, Anony.

On May 8, 2019, the North Carolina Court of Appeals took about a dozen cases into consideration, but held hearings in open court on but two of them. Mangum's case was not selected for oral arguments, so it was debated behind closed doors amongst three judges. It is my understanding that it will take approximately three months for the decision on Mangum's case to be written and presented for public consumption.

So, you are correct that I was not in court that day, as Mangum's case was not presented at hearing. Consequently, neither was Mangum present.

I believe the reason they stopped commenting is because they see the writing on the wall and realize that Crystal Mangum will be released soon and exonerated. (Probably getting some pre-emptive counseling.)

Anyway, some of the comments from Dr. Caligari and others have served to direct my strategy and even give some enlightenment about the legal process.

So, I welcome opposition comments, but thanks for looking after my back.

A VERY, VERY, VERY IMPORTANT ANNOUNCEMENT!!!!!

At long last, it seems as though the light at the end of the tunnel is the end of the tunnel and not the oncoming headlamp of a locomotive. In other words, I believe an end to Crystal Mangum's plight of unjust incarceration is around the corner... within a month, or possibly two at the most. It has been a long, hard, lonely war, but with Mr. Truth and Lady Justice in the trenches with me, plus a new battalion of recent recruits, victory is at hand... definitely in arm's reach.

It is my belief that Ms. Mangum will be released from confinement during July, if not in late June of this year. Much work behind the scenes of which I have not had the opportunity to share, is responsible for the anticipated positive outcome.

Even though Mangum's war is nearing its end, viewers of this blog site should not be disheartened because there are other wars on the horizon... including Shan Carter.

For Mangum/Nifong detractors, I strongly urge you to start looking for your crying towels. If you would like timely receipt of a crying towel, orders should be placed with me immediately. For you die-hard Mangum/Nifong detractors, I would suggest that you begin seeking pre-emptive psychological counseling. It couldn't hurt.

One final message: until the middle of June I will mostly be off-line working on finishing touches and preparing for Appomattox.

59 days seems like an eternity. I will tell you this: that I believe Crystal Mangum will be released from prison long before then. You'll likely start seeing a turn of the tide by month's end. Hey, Anony.

First, you forget that there is an appeal that has yet to be published. I'm expecting that the decision will be reversed and remanded. Ultimately, I believe that Mangum will prevail in that civil suit for Malicious Prosecution.

A win there could very well set the stage for an MAR. But I don't think it will get that far because I believe that she'll be out before then.

As far as getting Crystal's hopes up, my tenet is that whenever truth and justice is on your side, there is always hope. That's a Harrism.

Additionally, is it better to have hope with activity, even though it may not be successful or even futile, than to have no hope with idleness?

I rest my case.

Hey, Anony.

I think that anyone who believes the justice system is fair and without corruption is naive. There is so much injustice that the few publicized inmates whose convictions are vacated and who are released is only the tip of the iceberg. Crystal Mangum and Ronnie Long are but two of many wrongly incarcerated, and A.G. Josh Stein is fighting to keep them imprisoned.

Regardless of what I do legally, it is next to impossible to succeed when race, privilege, and culture factor into the equation. Unfortunately, judges often rule for a desired outcome rather than a fair and merit-based one. That's the unfortunate reality.

Thank you for your offer of assistance in his case.

For more than seven years I have been advocating for Crystal Mangum, the Duke Lacrosse accuser who was the victim of a vindictive prosecution, unjust conviction, and wrongful incarceration as payback for her role as accuser in the Duke Lacrosse case. Due in large measure to media vilification of Ms. Mangum, she has been ostracized by the public and there's been no one to help her. The NAACP, ACLU, SCLC, the innocence commissions/projects have all refused to help her. The Indy Week not only has refused to write about her case, but has done its best to discredit me (August 21, 2013 - "Is Sidney Harr's crusade for Crystal Mangum backfiring?"). My response to this inflammatory article was in the following week's issue.

The point I'm trying to make is that no one, other than myself, is doing anything to help Ms. Mangum. In contrast with Ronnie Long, he at least has support of The Indy Week and others. People have staged rallies on his behalf and pressed for his freedom. Because he's had so much support and Crystal's had none, I've spent most of my time/energy working on her case. Also, I thought with his story and evidence of innocence that he would be released soon. However, some time ago, after seeing the Indy Week article about him I did include him in a sharlog (an interactive mini-documentary). I also sent him money periodically through J-Pay until in February 2019 the sending of money was restricted to the one person on a visitor's list. That is, I can only be on one inmate's visitor's list, so I can only send money to Crystal.

I am trying hard to get Attorney General Josh Stein to provide justice for Crystal and for Mr. Long, but he, like Roy Cooper and Durham District Attorneys including current D.A. Satana Deberry have been ignoring me. My latest letter to A.G. Stein seeking a meeting was dated May 29, 2019.

Ronnie Long case is now with the Fourth Circuit Court of Appeals in Richmond, VA. On, I believe, March 20, 2019, the Fourth Circuit heard his appeal. A decision has probably been made on his case with the judges working on a draft which has yet to be published. I've been told it takes approximately 90 days for a final order to be entered. So, anytime now the decision should be published.

Since you no longer live in North Carolina and are interested in advocating for the wrongly convicted, I could suggest that you consider joining the Committee on Justice for Mike Nifong. It is a grass-roots organization which I co-founded in June 2008, with approximately fifty or so members. There is no requirement as far as dues/effort. The only requirement is lending your face and name to the cause of justice, which is substantial. (For example, your face would be placed among those on the beginning and end of the above linked sharlog... your name in the margin of the stationary page three.) Also members get a tee-shirt with j4n logo, a certificate mounted on foam-core, and a set of business cards. We're not a 501(c)(3) organization. We don't solicit money or do fund-raising. I use money from my pocket to sustain the group.

I have written letters to the AG’s office on behalf of Mr. Long. I did not expect (nor have I received) a response. I personally believe that the best way to combat a legal injustice such as Mr. Long has been facing is to let those in a position to do what is right know that WE know that they are the ones who can and should intercede.

I am also aware that there are many more who have done the same.

With that said, I haven’t been able to find much actual information that makes me feel quite the same way regarding the innocence of Ms.
Mangum.

Outside of your group, who else is involved with the, for lack of a better term, “Free Crystal Mangum” movement? I’d like to speak to someone with a more objective view of her case and find out what, for them, was the defining moment when they came to the realization that she was unfairly jailed.

I haven’t had much time to go through you blog, however. I actually found it by accident while looking for updates on Mr. Long’s case. I’ll leave off here until I’ve had any opportunity to read more.
